That depends strongly on the country and the circumstances, including where the photo was taken. In general the copyright belongs to the photographer, but it can be sold (for example, to the person who paid to have the photo taken). The payment of money is not generally enough: it needs to be stipulated that the copyright transfers to the purchaser (consent forms and similar).And the model? If you pay a model to take photos, you should get a release form. Otherwise the situation is unclear, particularly dependent on the jurisdiction. If you don’t pay a model, you might still need a release form if the photo is taken in private places. What legal limitations there are on using a camera to take photos/video fall into very narrow and specific cases. Shooting where there is a legal “expectation of privacy” (e.g. dressing rooms, bathrooms, etc.). Creating content that is inherently illegal (child pornography). Or doing your photography in a manner that interferes with public safety or police orders (not the fact you are taking your photo, but rather where you are positioned when you do it).No one has an inherent right to their face, appearance, or presence in a location, such that it blocks someone’s right to photograph them. They may have Personality Rights that limit use of the photo after it is taken, but none that prevent the photo from being captured.Now note, there are private property rights that give a de facto ability to prevent photography. I can place conditions of entry on a concert venue that require all sorts of specific behavior: no photos, no audio recording, no gang-identifying clothing, no dogs, etc. This is about behavior, not about the legal right of free expression. Breaking these rules does not result in the photo being destroyed as a legal consequence, it results in ejection from the premises—and a trespassing citation if the venue is really pissed off at you. Photographing a person in Germany as the central subject of a photo is actually NOT legal without consent unless they are a public figure, newsworthy in some fashion. Greece has a similar, although less broad law. But most of the West just says “shoot those photos”.
