In 2016, I had filed a PIL in the Supreme Court on behalf of the NGO Lokniti Foundation and had argued this case in the Supreme Court for linking of mobile phones with Aadhaar number of the subscribers. On 6th February 2017, the Supreme Court had directed linking of Aadhaar with mobile phones. Our main concern was national security as more than 5 crore mobile phone subscribers were not verified and unverified mobile phones had been used in a large number of offences, including terrorist offences. Read the Supreme Court order in that case, in which the Supreme Court had placed on record its appreciation for our PIL by noting that the “petitioner has approached this Court for a commendable cause” and by mentioning that “While complimenting the petitioner for filing the instant petition…”. This was the first positive order from the Supreme Court relating to linking of Aadhaar number.However, subsequently, a lot of people with vested interests have been challenging the Aadhaar system. A section of the so-called liberal media has started a witch-hunt against the NGO Lokniti Foundation and a lot of confusion is being created in this regard in media.Aadhaar has tremendous advantages. It has already saved tens of thousands of crores of rupees of Government money which used to be pocketed by middlemen out of the subsidy and various other schemes. Linking of Aadhaar with mobile phone subscribers has advantage in the field of national security and crime prevention and detection.And, as mentioned by you, in your question, Aadhaar linking with Voter ID card can prevent bogus voter cards which may be in millions. This has the potential to cleanse our elections of bogus voters and bogus voing.The problem is that there is a strong lobby of people with vested interests (including in media, lawyers, politicians, middlemen, foreigners) who do not want Aadhaar. They challenge it in the name of privacy. They are not bothered if mobile phones collect their fingerprints for unlocking their mobiles which can be misused by private mobile companies. They are not bothered if Google, Facebook, etc., collect details of all their online movements from one web page to another. Most of our online information may already be subjected to privacy risks, and such information is stored in foreign servers, including Chinese servers. Our emails may be read by email service providers who share them with NSA and other agencies in USA. But, they don’t want Aadhaar to save even the basic information, in spite of the UIDAI clarifying several times that they do not collect any information other than authentication requests while authenticating various transactions and that they do not store any such additional information.Linking of Aadhaar number with Voter ID Cards can ensure that only a genuine voter can cast vote. Bogus voting can be put to an end. It can improve our democratic system. The election system can improve and be made fool-proof. But, there are certain powerful lobbies who oppose this.As regards the linking of Aadhaar number with the Voter ID cards, let me point out that the Election Commission had started seeding Aadhaar number to the EPIC Database [Electronic Photo Identity Card Number mentioned on Voter ID cards] in 2015.[1][1][1][1]Last month, the Chief Election Commissioner had stated that as many as 32 crore Voter ID cards had already been linked to their respective Aadhaar numbers. For example, I had linked my Aadhaar number with my Voter ID card about 2-3 years back. However, at present this process has been put on hold due to challenge to Aadhaar system on the grounds of privacy.The Aadhaar system has been challenged in the Supreme Court. A Constitution bench of the Supreme Court, consisting of 5 judges, has been hearing these petitions challenging Aadhaar. These matters have been heard for as many as 38 days by the Supreme Court. This is the second longest number of days that a case has been heard in the Supreme Court.Today (10th May 2018), the Supreme Court has concluded the hearing of these matters and it has reserved its judgment. So, most likely, after the summer vacation in the Supreme Court, when the court resumes work in the first week of July, the judgment in Aadhaar case would be delivered. That will clear the clouds over Aadhaar system.My personal feeling is that the Supreme Court will uphold the Aadhaar system. However, it may insist for certain safeguards for ensuring data protection. It may ask the Government to enact a data protection law or a full-fledged privacy law. It may also direct that in exceptional cases, the essential services should not be denied to the citizens even in the absence of Aadhaar number. But, over all, Aadhaar system will be upheld, this is what is my understanding after having seen the developments in the above case.Once this judgment comes and if the Aadhaar is upheld, there is a good likelihood that linking of Aadhaar with Voter ID cards may be revived.Last month, the Chief Election Commissioner O.P. Rawat had further declared that while 32 crore Voter ID Cards had already been linked to Aadhaar, the remaining 54.5 crore Voter ID cards will also be linked to Aadhaar as soon as the Supreme Court gives its approval to Aadhaar.[2][2][2][2]So, let us wait for a few more months.
