Can you tell me about a time that you sued someone in civil court and won?

I rented a house on a month to month basis. It was an old house, not updated and didn't come with a refrigerator. I was young and didn't have much money, everything I had was precious to me & had a use—only the necessities, nothing extra. Because of that, I also treat other people's things with respect. I took really good care of this little house, sprucing it up with flowers, keeping the grass cut, curtains in the windows, no clutter, rent always on time, etc.I was using a cooler & trying to figure out what to do about getting a fridge when I found one in the shed on the property. It was………… vintage. But it worked! With some help, I got it inside, cleaned it out and that problem was solved. I even bought some appliance paint and painted it to look like brand new (-ish, it was at least 40 years old)Unfortunately, after just 6 months, I received a job offer in another (big) city, the city landlord actually lived in, in a very nice area. I gave 30 days notice to the landlord. Surprisingly, he was very nasty about it, claiming this was a huge headache for him because now he would have to go through all the trouble and expense of renting the house again and that he was a very busy man who didn't have time for this. I refrained from asking him why he was investing in rental property, especially in another city, if he was so busy.I moved out but before leaving I made sure it was in exactly the same condition as before I moved in. I left nothing behind, everything was clean and neat so he could immediately begin showing the house. I did however leave the working refrigerator, plugged in and running, in the kitchen. Thoroughly cleaned out.A few weeks later, I received an envelope in the mail from the landlord. I expected it was my the check to return my deposit. Oh no! It was a BILL for what he claimed was hauling trash, old clothes and junk out of the house and leaving it in such bad condition that it took him weeks to get it clean enough to rent again.I was furious! I needed that money since I'd had to pay a deposit on my new place plus the moving costs - it wasn't a lot, $500, but it was a lot to me! I made an appointment for a free consultation with an attorney who suggested that I file in small claims court against him. He advised me to employ a little known rule in our area that allowed me to not only recover the deposit, but a $20 ‘late fee’ for every day he held it past my move out date because technically he was supposed to meet me there on the last day & go over everything and return my deposit. Of course anyone who has ever rented knows that rarely happens but they usually get their deposit returned in a few weeks so they don't mind. He told me most landlords don't show up because they know they're going to lose unless they have a really good case.I took his advice and filed the claim. When the date came I appeared in court. To my surprise, landlord was there! He had taken time out very busy schedule to come and argue returning a rental deposit to a 23 year old young woman making barely above minimum wage! He stated his case, that I had rented the house then moved out 6 months later, leaving the property littered with garbage, piles of dirty clothes, cat pee soaked carpet (I didn't even have a cat) and a ton of rotting food in the fridge. He claimed he had to rent a truck to haul it all away. He also complained that I was constantly late on my rent & caused him tremendous hardship. I was stunned. He was so arrogant & superior acting, very cocky and confident. The magistrate asked if he had been able to rent the property again, he said that he had. When asked how long it was vacant, he said about 10 days.It was my turn to speak. I denied all of his claims. The magistrate asked if I had any proof to support my argument. The landlord smirked at me, thinking the young small town girl wouldn't have thought to bring anything to prove my case.He was wrong.I pulled out my little file and inside was a copy of every rent check with the date it was deposited & cleared, clearly stamped on the back. I also had a pack of photos, with a copy of the local newspaper in every shot to prove the date. The photos were of every room in the house, the outside, the shed, everything. I explained to him that he had rented me a house with no refrigerator and that I had in fact provided him with a nice working fridge as was seen in the photos. I also showed him an ad for the house, that landlord had run 2 days after I moved out. And that he was charging $75 more a month because “appliances included”.The magistrate looked at the checks, then at the photos, then studied the ad, then at me for what felt like a long time. He then smiled at my landlord and said, “Please provide Miss Smith with a check in the amount of $1800 within 5 days from today. If you are late by even one day, the amount doubles every day until we've reached the limit of damages allowed in this court. You should be ashamed of yourself for taking advantage of your renters, especially for the amount you're charging! This young lady improved your property to enrich you $75 more per month and according to this ad, that you placed 2 days after she moved out, you described the property as “immaculately cared for, sparkling clean home with restored vintage appliances”. How is this possible just two days after you claimed she left it in such a terrible condition? You're on my radar Mr. Asshole. You and landlords like you. Don't let me see you here again.”I received my check by courier the next day. To be truthful, I kinda was hoping he'd be late lol!

What was the most life-changing experience you had in India?

Going anonymous because I might get a lot of hate for this.I am an Indian and have been living outside India for the last 10 years. I visit India every year and have been exploring shifting back to India in the last 2–3 years until the below incident happened.I had purchased a 2 bedroom apartment in India about 3 years back. I had to use up all my hard earned money and also take a home loan to purchase this apartment. Since I live outside the country, I rented it to a local acquaintance whom we knew for the last 20 years. This guy kept paying the rent regularly and would always answer my calls. After about 2 years of renting, I had to ask him to vacate the house since I had to accommodate my in laws in my apartment. The tenant requested for an extension of 6–7 months to which I agreed, he was in touch with me through out this period and at the end of it he also gave me a date when my in laws could occupy the premises. The tenant went incognito about 2–3 days before he was to hand over the keys, when all my calls went unanswered I asked my in laws to visit the apartment and meet him in person. That’s when we realised that this tenant had illegally leased out my apartment to someone else and has gone absconding, it turned out that he also had conned a lot of other people in the area and run away with cash amounting to about 10 crores. We approached police on this matter and they refused to file a complaint, they asked us to approach a lawyer since according to them this was a civil case. At this point we approached the most famous lawyer in my city, he took his own sweet time to serve a eviction notice on the illegal tenants. It would take hours to meet this lawyer and he seldom updated us on the progress, he confirmed serving the notice and advised us to wait till the eviction notice period ended for the next steps. We were in for a rude shock when we went back to the lawyer’s office after the eviction notice period ended, he informed us that the tenant never received the eviction notice and the notice cannot be deemed served. He now wanted us to take this matter to court and told us that it would take a minimum of 2 years to get the illegal tenants out.It was close to 5 months after the matter was discovered and we were fed up of running from pillar to post on this matter, we decided to approached a relative who was a police commissioner for advise. Things changed as soon as he made a call to the local police station, the illegal tenants were immediately summoned to the police station and asked to vacate or file a complaint on the man who conned them. The illegal tenant apologised and left the station and he started pestering me to settle the matter between ourselves.During my interactions with the illegal tenant, I realised that the lawyer I had approached was his acquaintance and both of them had plotted to drag this matter in the court for as many years as possible. He also knew the exact details of my rental agreement with the original tenant and wanted to exploit any loop hole in the agreement. It also came to my notice that the fake lease documents for the illegal tenant were prepared in the office of the lawyer I had approached. The illegal tenant is now trying to force my hand to file a police complaint, he calls me in nights and claims that I have been threatening him, he has openly told me to approach the courts so that he can stay in my apartment without paying a dime. This is the sorry state of affairs in India, it is a appalling to noteAll the people I have been dealing with are educated, they are either graduates and double graduates. Yet they believe in conning others and taking them for a ride, none of them want to make a honest living. They would rather get a free pass on others than work hard.Police and lawyers are supposed to be safeguarding the society but yet they seem to be the first hurdles for any problem resolution.Even though I am legally correct and have all the right documents, the system is Indian sub continent still protects the wrong doer. The illegal tenants living in my apartment are least bothered about the amount they lost to the conman, but they are hell bent on wanting to create trouble for me. Instead of frowning on such an act, this undeserving society even has lawyers who support such crooks. This is what happens to a society when you choose crooks as your elected representatives. When you let people like Vijay Mallya, Nirav Modi off the hook you are setting a example for the society where everyone thinks that they too can get away with such things. There is a inherent belief among Indians that anyone living in the west earns in dollars or pounds and should be milked well. This is a horrible attitude, a lot of us work really hard, we go to office in freezing temperatures risking our lives and we work doubly hard because we cannot afford servants in the west. Attitude of entitlement is one of the worst Indian traits, what is the use of a rich culture and spirituality when every second thought in your brain is about how to con others or create problems for others. You can brush this under the carpet all you want, but deep down you know that given a chance many of you will be happy to take a free ride on others. The epidemic of conning others and getting away with it is becoming rampant in India as the employment rates plummet, every other day there are people coming out with similar stories. This was not the India I grew up in, I hope they wake up before it is too late.

What was the worst corporate culture you experienced? What made it so bad?

I worked as an apartment complex manager for a very large complex. I was thrown into the position when the previous manager failed to deposit the entire month’s rent from all of the tenants and had it all stolen. I was expected to recollect ALL of the stolen rent! Surprisingly, I did! I was then charged with bringing occupancy up to 100% and maintaining that.If you’ve ever worked in an apartment complex, you will recognize how difficult that is!Over a period of the first 6 months on the job, I was able to bring occupancy up to 100% and maintain a 90% occupancy for the 18 months I worked there. I brought late rent payments up from a 70% to a 15% with 100% collection on all fees. My residents were happy and we received numerous community recognitions. My maintenance team was top-notch and happy! However. The property owners were middle eastern and were highly specialized professionals in their chosen career fields. They were accustomed to people jumping when they snapped their fingers and I simply did not fit that bill. The owners lived on the west coast while the property I managed was in the southwestern states. I was vocal and demanding with my job. I expected the owners to be diligent in maintaining the property and didn’t allow them to shortchange the tenants. While the owners expected 100% devotion from their tenants and employees, we were all treated as second class citizens. NOT the way I view life. And, certainly not the way I will accept to be treated. The owners were very abusive and money driven. They were wealthy and expected us “lower” humans to bow to their every whim. I simply did not. The final straw came for me when the husband called my office and referred to me as “that Fucking Idiot”. I lost my temper and informed him in no uncertain terms that “that Fucking Idiot” had just once again maintained 100% occupancy for three months in a row with 100% collection on all rent with 80% rent paid in full on the due date and all late rents and penalties collected within 6 days of the due date. I pointed out that maintenance costs were at an all time low and that he should be “kissing my ass” rather than treating me like gum stuck to the bottom of his Italian made shoes.I then hung up on him, closed and locked my office, drove to our regional manager's office and handed her my keys. I did not give any notice. I was terrified as I had two teenage children to support, but, felt that digging ditches would afford me more respect than I was currently receiving.I found a much better job that I loved with almost twice the pay which I stayed at for over 10 years! I’ve never regretted my decision. However, the owners did regret it. They called me for months begging me to come back. I finally changed my telephone number. The last I knew, they were forced to turn their property into a low-income property and lost their shirts.Karma.
