A case that’s not settling may be in stasis awaiting a trial date and that means no action for several months and nothing for the attorney to report. This situation may explain why the lawyer is not in contact with you. The lawyer should have advised you that nothing will happen until [trial date] in several months. This is not necessarily right, but that may be what’s happening.I can’t give you advice because, as you can see, there aren’t enough facts to make any definitive answers.Now, to address the attorney’s lien. This is a serious red flag. I can’t tell whether you are the plaintiff attempting to receive money or the defendant who is attempting to pay money in this matter. The current plaintiff’s attorney must pay all liens out of the settlement before the plaintiff receives any part of the settlement. This means that all medical bills, hospital bills and attorneys’ bills must be paid. It happens from time to time that a plaintiff changes attorneys in the middle of the case. The discharged attorney will file an attorneys’ lien.Here’s an example of how an attorney’s lien may work. Plaintiff hires attorney A to sue for injuries arising from traffic accident. Two months before trial plaintiff switches attorneys and hires attorney B. Attorney A files an attorney’s lien on the case. Case settles just before trial for $100,000. First, the medical bills of $30,000 must be paid. Attorney A’s fee is one third of recovery, or $33,000. Attorney B’s fee is also paid in the amount of $33,000. The net $4,000 is paid to plaintiff. Obviously, plaintiff will be very very unhappy in this situation. From the defendant’s side, it’s very difficult to settle cases entangled with attorney liens. Most plaintiffs who realize they will get next to nothing in a settlement are inclined to just try the case.The combination of attorney non-communication, settlement aspirations that are not clearly described and the presence of an attorney’s lien may be signs that the case is in serious trouble and that’s why it can’t be untangled on Quora. I can say it is likely to be disastrous to speak with opposing counsel yourself.I can only recommend that you retain the services of a local attorney and pay for a 2 hour consultation.
