However, sources share that this year Delhi University (DU) authorities will commence the admission process for UG course admissions by end of March 2017 and the same would continue till mid-June.It has been shared that this move is being undertaken to give aspirants more time to complete their registration process. Excellent Question!Earlier under construction property was deemed categorized as Work Contract, as per applicable rules, abatement 75% for total consideration under 1 Cr. & 70% for property consideration over 1 Cr. resulting in effective rate of service tax as 3.75% & 4.5% on total consideration respectively.Further 1% VAT was applicable on total consideration respectively.Total tax on property less than 1 Cr. was 4.75% & on property more than 1 Cr. was 5.5%, apart from Stamp duty & Registration.GST committee has declared slab of 12% for under construction properties, so basically, 4.75% & 5.5% tax got converted in to 12%.However committee also allowed full Input tax credit for developers, which was not applicable earlier under service tax regime.Also committee stipulated that benefit of such Input tax credit should be passed on completely to buyers.Given the provisions of GST law, its clear that on the transaction value GST shall be applicable at the rate of 12%, hence if you are paying your contract in installments in pre and post GST era, you should be paying 12% on transactions after 1st Jul 2017.This were the law stands, to answer your question YES! You have to pay 12%BUTEarlier law did not give input to any taxes paid by the developers, there by those were the cost to the developers, say steel, cement, labor, etc. had a portion of tax even under the earlier laws but were not given as input to the developer and ultimately it was collected from you since it was a cost to developer.Now, under GST the same taxes paid on earlier laws and new law is fully allowed, remember even for the transactions carried out for the past one year on unsold stock (i,e under construction flats) input shall be allowed for the developers.Therefore, post GST era, developers should revise their contract value by reducing the amount of input benefit it gets.Example, Say under earlier law 5lacs was VAT on steel and your total contract value was 100lacs, now the government shall give back the 5lacs to developers via Input credit and hence to pass on this benefit he has to reduce the Contract value to 95lacs (100–5).Practically the developers are not clear as well, whether they need to reduce contract price or do that need to reduce Input tax credit from GST liability directly i.e not taking the inputs on the past transactions, even though they can, to avoid compliance burden.To conclude, in your case, you have to pay GST at 12% on your Contract Value, but, talk to your developer and enquire if he has taken the Input and if yes, then has he reduced the contract value to that extent.In case you feel the GST benefit is not being passed, wait for few more days, the Government is in the process of setting up an Anti-Profiteering committee which will look into the complaints of non-passing of GST benefit to customer.Hope this helps.
