That means that he is neither a US national nor a US lawful permanent resident, and thus not eligible to be the petitioner of an I-130 petition.It is, however, possible that he could be the beneficiary of such a petition, filed by you (after you have married him, that is), if you are a US national or US lawful permanent resident. But you, not him, will have to file the petition. Immigration petitions in the US are filed by the sponsor, not by the beneficiary, and there are very few situations in which the sponsor and the beneficiary can be the same person—and none of them involve Form I-130.
