Because you can give Tom Brady just about any team to play with, and he’ll come out a winner. He may not be able to consistently win, or even make it to, Super Bowls every year, but he’ll certainly put them in the playoffs. Few quarterbacks in history have had as diverse teams, and receivers to throw to, as Tom Brady. You can name famous QB/WR connections all day long, and you’ll have difficulty connecting Brady to any one favorite target for an extended period that was truly great (except maybe the overrated Wes Welker for a brief time).Also when Brady came to the NFL out of college he was considered a nobody, not much more than a backup clipboard holder that only went in if the main guy went down. He was pretty much considered average in just about every category. But when Drew Bledsoe went down, a legend in his earlier years but heading over the hill fast, Brady made the most of his chance by winning a Super Bowl. He proved over the next several years that he was no fluke, consistently improving year after year and working hard to improve himself physically and mentally. Even after several setbacks (losing a couple Super Bowls which were very winnable, one after a perfect season, and having to sit out a season due to injury) Brady was able to come back and play at a high level, which he continues to do today even at a very advanced age for many NFL players. And he has that mental attitude that all the greats have had, that he’s a winner, he plays to win, and he’s gonna win no matter what it takes.And no, I’m not a New England fan. And yes, many will say he cheated, as well as the overall team itself. The only thing I want to add, after reading your “comment” elaborating on your fact scenario, is that you seem to be misunderstanding the amount of hurt you would put yourself through if you refuse the simple request to SIGN a statement you have already given, versus how EASY it would be to just do the minimal favor that is being asked of you. How long does that take - 5 seconds of your valuable time? You already GAVE the statement; they are just asking you to sign it. The lawyers for the injured lady will mail (or email) the unsigned statement to you, and ask you to sign it and return it to them. If you are too busy to do even that, they will probably be willing to come by to your home or place of business in person, put it in front of your face on a clipboard, hand you a pen, and let you keep the pen. Chick-chock, you’re done.That’s the EASY way to do your duty as a member of civilized society, to give testimony when called upon, if you have personal knowledge of some fact relevant to a legal matter. But as Mr. Williams explained to you in detail, the lawyer for the lady can also force you to do it the HARD way, by sending men with handcuffs and guns to get you and throw you into a concrete box until you change your mind and agree to testify truthfully and FOR FREE. Since, of course, it is against the law for lawyers to pay fact witnesses for their testimony (other than compensating you for your travel costs and lost wages, if any, which the lawyer MAY do if he chooses, but is not required to pay you in state court) and the lady’s lawyer could get disbarred (lose his license to practice law) if he gets caught paying you money for your testimony. Not to mention that YOU could wind up in jail for committing the felony of extortion if YOU get caught demanding such payment, or for committing the felony of perjury if you testify untruthfully from spite over not being paid.You SAW this lady fall, you knew she fell in the ice cream that had not been cleaned up yet half an hour after you had reported it to the mall authorities, and no one else saw this process happen from beginning to end as you did. (Even if other customers in the mall saw the lady slip and fall, they would have had no personal knowledge of HOW LONG the ice cream spill had been on the floor — nor would the lady herself.) From your detailed account of it, the mall honchos appear to be willing to lie about the timing of this matter — claiming that the spill you reported (and of which they have a written record they cannot deny) was cleaned up promptly, and had nothing to do with the lady’s fall — “maybe she’s just a klutz,” they might say.That means THEY are being criminally lying assholes and committing a grave injustice, depriving this lady who was injured due to their negligence of even minimally fair compensation for the injury they caused. What the mall honchos seem willing to do, in short, is to commit perjury themselves — lie under oath — if they are eventually called to testify about what happened at a trial of the lady’s case. Because of their dishonesty, they are willing to bet on the case simply fading away, being dropped by her lawyer as unwinnable, so that they don’t even have to testify — or letting the lady’s lawyer think that if her case go to trial it will be thrown out because the perjuring honchos are willing to say they cleaned up the ice cream spill right away, if there is no honest person (you) who saw what actually happened and was willing to testify to the contrary and prove them to be liars. So, they are counting on winning without even NEEDING to actually perjure themselves. Maybe, if push comes to shove, the mall managers will NOT be willing to risk going to jail over mere money, which they by rights should owe, and will settle with the lady “on the courthouse steps” even without your testimony. But, they are counting on putting the “squeeze” on the lady and her lawyer, by refusing to settle until the lawyer and the injury victim both exhibit determination of steel and show they are willing to take the case all the way even at risk of not being able to make a winnable case without your truthful testimony about what happened. Most lawyers, AND most clients, are not willing to take that risk, so the lawyer would probably just withdraw from the case, and the injured lady would have a hard time finding another lawyer to step in, and the case would just quietly go away. Insurance companies and negligent corporate defendants like the mall COUNT on this happening, as often as possible, and so they habitually make it hard for an injured victim to get fair compensation. This lady is NOT “winning the lottery” even if she does get some money for her injury. She is just being compensated for something that was already taken away from her — her good health, her pain-free life, her ability to stroll through a busy mall without constantly worrying about another dangerous and barely-visible ice cream spill lying in her path on the shiny tile floor.So, for you to refuse to testify would cause a serious injustice. It would reward the mall management’s lies. It would deprive a genuinely injured woman who did nothing wrong, and who was hurt because of the mall’s negligent sloth in failing to respond promptly to the ice cream spill, just as surely as if a mall security guard had whacked her knee with a baseball bat, of any compensation at all for her medical expenses, lost wages, and pain. All of which makes our society as a whole, a bit less civil, a bit less trustworthy, a bit less fair, and a bit less nice. If EVERYBODY reacted to the situation the same way you are thinking of doing, then society as a whole would very quickly turn into quite a hellhole — just “every man for himself.” Life, in other words, would be “nasty, brutish, and short,” as Thomas Hobbes famously wrote, if the social contract we all rely upon for civilization to exist, were thrown to the wind.Don’t be an asshole. Don’t contribute your little bit to the end of civilization as we know it. Do your duty as a member of society, and agree to testify. It will go a lot easier on you if you do.
