PDF Editor FAQ
What would be a good way for a venue (e.g., a coffee shop) proprietor to hang and sell a freelancing artist's work?
There are a number of options. The most common is for the 'gallery' (ie the venue proprietor - it could be a cafe, bar, restaurant, art gallery) to sign an agreement with the artist, under which:1. the gallery takes specific identified works "on consignment" and agrees to display and offer the works for sale at the relevant premises; and2. the artist authorises the gallery to sell the works on behalf of the artist, for specific prices which can be listed in the agreement (or calculated by a formula set out in the agreement). The legal title to the works isn't intended to change under a "consignment" arrangement, but possession of the works does change - the artist agrees to give the gallery possession during the consignment period (or until a work is sold by the gallery to a customer, if that happens sooner). If the gallery sells a work, the gallery then invoices the artist for the agreed commission (eg 30%) and remits the balance to the artist. The agreement (sometimes called a "consignment agreement", but there's no special name and I've seen lots of different ones) should cover the above, also who bears risk of loss/damage/theft for the art works (is it a good idea for insurance for lost, stolen or damaged works?), and what means can be used for payment (eg, cash only, debit card, credit card, paypal, etc), and who bears the risk of non-payment (eg, what if the customer pays by credit card and the payment is reversed by the credit card company, but the person has already taken the art work away and can't be found)So there are a few things to think about, whether you're the artist or the gallery, but it's not exactly a new path and if you look for help from an organisation like Arts Law Centre of Australia (which has a number of template agreements for artists or galleries to use) in your State ... see this Page on artslaw.com.au for some examples. I've helped artists use the Consignment Agreement - Artwork and it isn't a big task to do, but may not be appropriate for your location so make sure you get somebody with local experience/knowledge.
Can an insurance company ask for a photo of your credit card?
I don’t think that they should be able to, and certainly in the UK does not occur. Just because the party is an insurance company doesn’t mean they are exempt from illegal or fraudulent activity; far from it.The main reason is that actually photocopying the card (again under UK law) is a breach of copyright. Also, the card does not “belong” to the card holder or signatory, but the bank. There is also a question of fraud here since with the quality of photocopiers and flat bad scanners, the details can be very accurate and transferred on to a plastic template. Of course this has been greatly reduced by “Chip n Pin” and real-time authorisation, along with CVV numbers; however no system is bomb proof.IFfa human brain can think it up, eventually another human brain will break it down. A good example is the Enigma Code of the German Military of the Second World War.
What is required to become a payment aggregator?
First, you will need an actual Merchant account with your bank. It must be a special type of account called MOTO (Mail Order - Telephone Order). Depending on the bank it also could be a standard Retail Merchant account under the "cardholder not present" agreement. Once you setup a Merchant account, you will get an MID (Merchant ID) and TID (Terminal ID) numbers. Traditionally, MID was used to identify the actual store and distinct TID for each cash register terminal at this store. If the business runs more than one store, it will have MID for every store. By sorting all of the MID's transactions by TID, you can see which terminal (and/or store) contributed which set of transactions. You will need this to establish your customer's accounts who will accept card payments.Next, you will need an agreement with your bank to accept and process transactions on behalf of your clients, since you are going to issue them your MID or TID. You can setup your business with a bank as a Master Merchant (or Payment Aggregator), but this model is not as easy as before. You will need to show your bank how you will manage credit risks, fraud risks, liability, security, disputed transactions (chargebacks), etc. There is no standard templates available for developing policies to address all these issues (aside of PCI DDS) and bank requirements will highly depend on your personal credit rating, your business model and the bank itself. The good news though, you are in the USA, and compare to UK or Europe, there are literally thousands of banks and options. Finally, once you have all the agreements in place, you will need an Acquiring PSP (Payment Service Provider), to handle all your electronic transactions and who will provide you with API. You will need MPI type of API (Merchant Processing Interface), so you can create your own 'wrapper' for XML in the programming language of your choice and process the authorisation requests and refunds, and also run a multitude of reports by communicating directly with and Acquiring PSP system over SSL.
