Coupled with the reduction of cash donation limit to Rs. 2000, journalists and analysts eager to please the government have been quick to call this historic, significant and move in the right direction.I am afraid this is the MOST retrograde move that as a nation we can give ourselves. It completely kills the demand to make political donations transparent and party agendas transparent and offers unlimited opportunity for political parties to indulge in corruption, extortion and laundering of wealth.But first, let me say a few words on the Rs. 2000 limit for cash donations. The Rs. 20,000 limit has been much talked about not because it was a big amount but because political parties were lumping all cash donations received under 20,000/- into a single head – unknown sources of donation. There was no record of who the donor is and therefore there was ample room for political parties to accept large cash, usually in black money, from donors who wish to dispose of their ill-gotten wealth and earn political favors. The recipient party only had to declare any amount of cash as “unknown source” and deposit the cash into their bank accounts, instantly laundering the black money thru exempt political party route. It is possible that many party treasurer / financial handlers may have dipped into the cash donations and made hay while depositing some part of the donation to the party funds – after all cash belongs to the holder is the best policy.In the new dispensation, the political parties will continue to receive unlimited cash and show it as receipts of less than Rs 2000/-. Many commentators have talked of parties cutting Rs. 19,999/- receipts and now offering Rs. 1,999/- receipts. While there may be some merit in this argument, it is not really needed. As a political party, I have only to declare receipt of Rs. 100 cr as cash donations with each amount less than Rs. 2000/- for all practical purposes. The identity of the donors who have donated less than 2000 each is not to be provided. As such, there is no need to cut 1999 receipts. It is just a nice picture to paint for making the point.Now lets get back to the electoral bond, which is the star of this article. The stated reason, as mentioned by the FM is to “protect the identity of donors”. Why do we need to protect the identity of donors when the nation is calling for full transparency so that the key influences of the political agenda can be known to all. Much has been said about crony capitalism, favoritism and governments giving undue advantage to certain corporate houses. Huge spends by political parties, well into tens of thousands of crores can only come from large corporate sources that seek capital and income returns from the government once their favorite parties have political power. The recent award of significant business from India’s purchase of new fighter jets is a good case study. Do we believe that the company given the contract has deep expertise, experience and credibility in defense arena? Or is the company “close” to the PM and a known donor? Clearly it is the latter. Now imagine if the public knew that this company had made a 1000 cr contribution to the ruling party for the election, everybody would understand how the govt of the day works and make appropriate decisions in future.a. Easy to Bribe PartiesHere's how the zeal to protect the identity of the donor goes against the interests of voters. Imagine a corporation seeking favors or inflated payment or illegal gratification from a politician / administrator. The easiest way for the politician to ask for a bribe / payment to party fund is “electoral bond”. Buy a bond at the bank and deposit the same with the party. Get a tax break (donations to political parties are exempt in some cases) in addition. No one in the public sphere need to know.b. Easy to Launder Money to PartiesWe are all aware of thousands of shell companies sitting on all kinds of illegal funds in India. Even AAP, which is very very careful about funding sources was unable to detect 4 payments from so called shell companies. In the case of AAP, however, voluntary disclosure by AAP allowed the story to break. Today nearly everyone tracking AAP is aware of the issue. Now imagine that these shell companies buy the “bearer electoral bonds” and donate. And no one ever comes to know. Isnt this a clear invitation for money launderers to park their funds with political parties?c. Easy to Route Foreign Money to PartiesA third risk is of funding from international sources. Imagine a corporation or individual receiving significant foreign money; using the same to buy electoral bonds and depositing it with the party. The public need to know. How then will we ensure that illegal, unsafe and foreign sources are not tainting our political processes? Just like the undeclared 20k limit was misused, the electoral bond will be misused to route foreign money into willing launderers and deposited into political party accounts.The argument against the limit of Rs. 20,000/- was not about cash or cheque payment. The argument was that the identity of the donor could be kept a secret. By enabling electoral bonds to hide the identity of the donor, GOI is making the same mistake as earlier, except this time the banking channel will be used instead of the cash channel.If you don’t trust my argument, just look at the state RBI has been reduced to post demonetization. Its over 40 days since the 31st Dec deadline and they are still unable to report how many notes have come back to banks during the demonetization period.
