Does it ruin the rest of your life to be arrested once for a misdemeanor?

Yes, it can, depending on the offense type and where it happened. I was arrested for driving on a suspended license, which is a Class B misdemeanor in Texas. It wasn’t a DUI arrest. That would have been even worse. A Class B misdemeanor doesn’t sound TOO bad, but it can be devastating, and sometimes the fallout can be even worse than having a felony.When I was arrested, the penalty was a steep fine, an additional suspension of up to 2 years, the possibility of going to jail for up to 180 days (I never served that much time), and an additional surcharge that was due every year for 3 years. Your car will also be impounded and you will have to pay to get it out.That’s not the last of it, though. You see, it’s very likely that you will lose your job if you’re arrested and jailed for even a few days upon your arrest. Since your license is now suspended for an additional length of time, you will not be able to drive for your search for a new job. Many jobs are now closed to you, jobs that require a valid drivers license which would usually be the kinds of jobs that a person with an arrest record would usually have a chance of getting. You can’t deliver pizzas, or drive a forklift, or do gig work such as delivery driving or working for a ride service or driving a taxi. You can’t work as a valet for a parking service. You can’t drive for UPS/FedEx. The list goes on. Your employment opportunities are already reduced simply because you have a misdemeanor arrest and possible conviction. If your consequences also involve the loss of your driving privileges, your available jobs are reduced even more. If you couldn’t afford to pay the 3 year surcharge, your license was again suspended for non-payment, even if it was already under suspension for the offense. Now how exactly are you supposed to pay a surcharge if your license is suspended for non-payment and you can’t find a job? At one time, my state had over 1.8 MILLION drivers in that very same position. Many of them elected to just keep on driving so they could at least look for a job, or keep working the job that they had. Most of them got caught again, and the cycle repeated… another ticket, another suspension, another 3 years of surcharges, more jail time, another impoundment, and probably they lost their jobs this time. Again… driving while license is invalid is a Class B misdemeanor. The only lower class is a Class C. This isn’t a felony.Many of these drivers were not drunk or driving like fools. Many were caught by cops using automatic license plate readers, and had not actually committed any other driving offense. Licenses here can be suspended for reasons having nothing to do with driver safety. Were you 17 years old and caught with cigarettes? Boom, your driving privileges are suspended. Were you behind on child support? Take away your ability to drive. Did another state fail to record a payment of a ticket for an expired registration sticker 20 years ago and issue a suspension in that state even though you have proof of payment? Bam, your license is suspended in this state as well. And now, you are a criminal who is charged with a misdemeanor. YOU BROKE THE LAW AND MUST BE PUNISHED!Even if you aren’t looking for a new job that involves driving, your ability to get to a job site is also impaired. You now have to find some other way to get around. For some, that means using public transportation, if it’s even available to you. But buses and trains don’t always run around the clock. Your available hours will center on the bus schedule. That reduces your available time. Buses don’t serve every place where jobs might be found, so many jobs that would be accessible by car are now out of reach. That reduces your employment opportunities even further. In some places, like where I live, there is a negative impression of public transportation and the people who depend on it. Even though it can be a form of discrimination against people with disabilities who aren’t able to drive due to their disability. There are employers who will not hire people who use public transit because having reliable transportation is critical to keeping a job, and a lot of employers don’t consider public transportation as “reliable” enough. Even if you have an alternative in case your bus is late or doesn’t arrive, it’s still not good enough. Also, some jobs require weekend, night-time or overtime work, and if there is no bus service on weekends or late at night, you cannot work those hours as needed.Besides all of those hurdles, a great many jobs now ask if you have ever been arrested, charged with or convicted of a crime, or if you have ever pleaded guilty or no contest to a crime, or if you have ever been on deferred adjudication for a crime. (“Deferred adjudication” means that you entered a plea of guilty or no contest but that plea and adjudication are set aside, and you are given certain terms to abide by for a period of time. Those terms will depend on several factors, and they can be quite lenient or very strict. If you follow those terms and successfully complete the supervision period, the plea is dismissed and you do not receive a conviction. It’s sort of like being on probation, but BEFORE you are convicted.) If any of those questions apply to you, you must answer “YES” to the application question, even if you were not convicted of your offense and the case was dismissed, as it was in my case. A “Yes” answer on an online application, which is the majority of job applications nowadays, pretty much ensures that your application goes into the “filter”, and you are virtually guaranteed to never hear back from that employer.Some US states and cities now have what’s called “Ban The Box” laws and ordinances, which means that you are not required to answer those questions on your initial application. Supposedly, this is to allow people with criminal records to have a fair chance at an interview, and a chance to explain their criminal record and how they have “reformed” or not had any more problems. But in reality, a lot of employers still toss those candidates into the trash pile, and if they follow up with that candidate, the candidate is told that the employer “chose another candidate with a more suitable skill set”, or whose qualifications more closely matched the position. Some states also have limits on how far back most employers can look into a person’s background. Seven years is pretty much the norm. But again, the reality is that if an employer or background check service finds a problem from even 30 years ago, they are likely to hold it against that candidate. The candidate has no way to prove that this is what happened, so those laws and rules are pretty much unenforceable.So for me, not having a valid drivers license, even though I’m now eligible to get it back if only I could afford to do so… coupled with a misdemeanor that was dismissed through deferred adjudication (and therefore, I have to answer yes to the criminal history questions) has virtually made me unemployable.If I could afford to do so, I could have that misdemeanor case sealed under nondisclosure rules, or even get it expunged. Then I could legally and truthfully answer “No” to the criminal history question, and with very few exceptions, an employer or background service would not be able to access that record. However, reinstating my drivers license costs money, and having that misdemeanor “sealed” or expunged also costs a few hundred dollars. I haven’t been able to get a job to pay for either one, so I’m stuck in a Catch-22. Even if I had the money to reinstate my license, getting an appointment for a road test now is virtually impossible with COVID-19. There are third party test companies doing the tests, but that’s an extra $95 on top of the DPS test fees. I need a job to take care of those loose ends, but can’t get hired because of them. This is why so many people are repeat offenders. The “system” says, “Pull yourself up by your bootstraps”, at the same time as they’re taking away your boots. Yet, if I had any other offense, even a DUI, there is a path to reinstatement, and I could have a restricted license in the meantime. If I was a person who was more wealthy from the start, this wouldn’t even be an issue. Poor and low income people and especially people of color (which I’m not) have few options. Even a person of color can claim discrimination or disparate impact and there would be a few options for them. There is nothing for a person in the majority population who isn’t wealthy or at least “not poor”. The surcharge program was repealed in the last legislative session, but that didn’t help those who still have to pay a reinstatement fee. It doesn’t erase any suspensions or charges. It doesn’t seal the record. We’re still stuck in the hole with no way out.Yes, my life has been ruined all because of a misdemeanor, and the unfair way that society… especially in a “Tough On Crime” state… treats people who have fallen into the criminal justice system.
