I do not know how corrupted the judiciary is but my experience has thought me one thing“Indian judiciary is a joke”Let me tell you my experience. I wanted to purchase a site in Bangalore and found one that belonged to a person of our community itself. I trusted him and paid him 65L which is about 80% of the total site value. Now after paying him he suddenly decides he is not willing to let go of his site. So quite obviously I requested him to return the money that was paid. But guess what, he was not willing to do that either. Even after several negotiations he openly rejected to return the money. I had all the bank statements and cheque's as proofs that I had paid him the money.I decided I would teach him a lesson and filed a case against him and since I had all the proofs, I thought it wouldn't take too long for the court to give a judgement in my favor. But boy was I wrong. It has been 7 years since I filed the case and every year I attend around 5–6 hearings hoping that this would be the last one. But each time after hearing the lawyer's arguments the judge simply schedules another hearing.Now I have very little hope left in me that I might get my money back. The value of the site that I planned to buy has increased multifold's and I have also lost the interest I could have earned from the money I paid him.Now if such a simple civil case such as mine could take so long, I can't imagine how long complex cases can take. Me as a responsible citizen who pays his taxes always feel that I am being let down by this joke of a judiciary in place.

Rule 41 is a Law applicable in China under whichAny Person (s) who are subjected to criminal acts while in the process of committing a crime or in the process of committing a violation of a law - cannot get civil or criminal justice from the system and is entitled to neither civil nor criminal justice.Eg:- A Person who crosses during a red light - gets hit by a Truck and dies. The Persons family is not entitled to civil or criminal compensation - even if the Truck brakes were defective. Rule 41 will say “Sorry. Your Son crossed the road when he should not have done so. Its his Joss. No Criminal or Civil Case”. The Driver can simply drive home without 10 minutes of interogation.Likewise - if somebody walks into a shooting range without permission and gets shot - no case - criminal or civil.If a Prostitute outside a red light area is beaten brutally by her customers - she cannot go to the cops or the court. She has to go home beaten and bruised because she broke the law by going outside the red light area.

Civil offences are offences against individuals or groups and which can be generally be settled with money or apologies etc..Any civil illegality becomes an offence if and only if challenged by the aggreived party .Eg: stealing someone's money or wealth or lands or house .In all such cases govt or police will not start prosecution. The logic is the person who has lost his money or house is not interested to fight it legally in civil cases ( which can be settled by monetory compensation . ) ,Govt or Courts on its own will not start cases Suo Moto .Civil Cases vs. Criminal Cases: Key Differences - FindLawCriminal offences are such ones which has a bearing on the society . And in cases wherein gravity of the offence is much more and much serious and if not punished can damage the whole society ,or can damage peaceful coexistence . Whatever given in above para doessnot apply to noncivil offences i.e. the serious offences which are criminal in nature wherein state govt thru police Dept becomes the prosecuting agency even if not challenged by the aggreived party . Eg: Murdering someone .Here govt , police or Courts can and will start the criminal case on their own even without knowing the suspects : Suo moto jurisdiction. The aggreived or affected person neednot start the case .Many a times aggreived person may not be knowing the perpetrator of such criminal acts and may not have the wherewithal to pursue such criminal cases to satisfactory conclusions. In all such cases the aggreived persons can join as a party claiming compensation or demanding higher compensation or demanding expeditious disposal of the case or can submit a plea to increase the sentence on the accused as a social deterrent for effective social justice.Like wise Karnataka’s ex Chief Minister Kumarswamy has two wives with two seperate houses and two families . Also Hindi cine actor Dharmendra also has two wives two sets of children .Since both the wives or children have never complained the case of illegality to police , or to court , prosecution never started . Similar is the case with Ram Jethmalani . None of his two wives and two sets of children ever complained on his two marriages and they getting affected in the process. So although illegal both the marriages ,both the families continued to exist peacefully .
