Acceptance of a pardon is not an admission of guilt.For those who do not know, there is a concept in law and jurisprudence called obiter dictum. It literally means (in Latin) “a thing said incidentally” or “a passing remark”, and is used to refer to things that a court says in its written opinion that are not essential to the disposition of the case, and therefore not binding law.In a case from the early Twentieth Century, Burdick v. United States (1915), the Supreme Court did in fact say that acceptance of a pardon implies admission of guilt.But this was not its holding—it was an obiter dictum made as part of its explanation of its holding that a pardon must be accepted in order to have legal effect, and that a person is free to reject an offered pardon. Nowhere did the Court state or imply that the ability to reject a pardon is contingent upon the desire to deny guilt, and in fact says, “…the reasons for his action were personal” (i.e., “it’s his own business why he didn’t want the pardon”).The Burdick dictum has become readily confused with binding precedent in the public eye largely because President Gerald Ford referenced it in defense of his pardon of President Nixon—that is, he noted that he was more comfortable pardoning Nixon when he reminded himself that Nixon’s acceptance of the pardon would imply an admission of guilt.But not only was President Ford no lawyer (he was admitted to the bar for a few months, but then shipped off to war and subsequently went straight into politics), his pardon of Nixon actually proves that the dictum cannot possibly be law, as Nixon was pardoned for,[A]ll offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in during the period from January 20, 1969 through August 9, 1974.How, exactly, could Nixon’s acceptance of the pardon constitute an admission to crimes that were never named or charged? Not only was the application of the Mann Act to target interracial couples unconstitutional in itself, but the incident used to convict Johnson occurred before the Mann Act was law—meaning even if the law itself had been fully valid, he was objectively innocent of violating it.Now, we should note that a “posthumous pardon” is effectively a political, rather than legal act, and of course it was impossible for Johnson to “accept” the pardon.But assume Johnson had instead been alive at the ripe old age of 140. Would accepting the pardon mean confessing his guilt? Of course not. It would mean gladly accepting vindication of his innocence.Lastly, I should note that acceptance of a pardon is not relevant evidence in civil court to prove the underlying conduct of a crime alleged.That is, if I were accused, but never convicted of a murder, and I accepted a pardon, my alleged victim’s family could not use my pardon as evidence that I had in fact killed the person and that I was therefore liable in a wrongful death suit.
