My retained and paid attorney failed to show up in court (on my behalf), Now he is ignoring me. His law firm apologized but the damage is done. What should I do?
Write a letter to the lawyer and managing partner at the firm describing in detail:when you retained them, what you paid them and when (enclose a copy of the engagement letter if you have one - many states require written agreements - if you don’t have one, mention that no written engagement letter was provided. Also enclose a copy of any receipt for payment),what services he was supposed to provide, what he failed to do,when the hearing he missed took place and what the hearing was for, what happened as a result of his failure to appear, how you were damaged as a result of his failure to appear, stating the fact that he apologized and how (phone, email - if email enclose a copy) and whenrequesting full refund of the retainer, and advising that you are reporting the attorney and the firm to the State Bar Association.Show that a “cc” of the letter including enclosures is going to the State Bar.Be sure to date your letter, include your full name and contact information, and to keep a copy of the letter and all other documents you are enclosing for yourself.Contact your State Bar Association and tell them you want to report this incident. They may have a form for you to fill out. If so, get it, complete it, and submit it with a copy of your letter to the attorney and all enclosures. If not, send them a letter telling them you are filing a grievance and enclosing a copy of the letter to the attorney and enclosures.A Bar representative may call you after you file your grievance for more information. If you suffered significant damage beyond the loss of fees paid, contact an attorney who handles legal malpractice cases to see whether you have a viable claim. Most attorneys will meet with you for free initially to evaluate your case.
Why does Sushant Singh Rajput's loss seem to be a personal loss to us?
His loss seems personal because he has inspired many engineers, and middle-class youth to pursue their dream. He was the ideal for many people and will remain forever. His loss shattered dreams of aspiring actors who have thought of meeting him, and share a cup of coffee.Yes, his loss isn’t personal but it seems like. People are mourning for him more than they do for their soldiers. Maybe, because it was unexpected or maybe, they knew him closely despite he being completely unaware of all his fans. Here’s my anger, pain, and love-filled letter for Sushant Singh Rajput.
What are the worst hangman words to use?
When you start a game of standard hangman, the player knows only two things:The word is in EnglishThe number of letters in the wordThat is, if you start a game as : _ _ _ _ _, the player knows only that they are looking for a five letter English word.* I am going to assume you are playing a rational agent who will be working to minimise the chances of each guess producing a penalty.**If so, they will look at the length of the word, and then guess the most frequently occurring letter in the domain of words of that length. So, rationally, in a five-letter game like the above, they should look up all five-letter words, and pick the letter that appears in the largest number of cases.(Most people don’t bother conditionalising on the length of the word, but simply guess the most frequent letters in the English language, on the reasonable assumption that this pattern will be approximately the same when you restrict down to words of a given length. ETAOINSHRDLCU is as good a rule as any other. However, this assumption becomes worse and worse as the words become shorter, so I shall not make it).OK, so the worst word to choose will be one that this rational player gets to immediately. You might expect this to be a one-letter word. So you’d start your game like this:_Here are only three options: A, I, O. But this presents a problem. Given the space of one-letter words, there is (obviously) no most frequent letter: the player can only choose one at random.***The player will certainly get it in three turns, with a 1/3 probability of getting it without any penalty, 2/3 of getting it with at most one penalty, and certainty of getting it with at most two penalties. So the player is guaranteed to win, but not immediately. This isn’t as bad a choice as is theoretically possible. Can we do worse than that?Let’s look at two letter words. Amazingly, there are 101 of them, at least according to the (bloody stupid) Scrabble rules. Grrr.(Source: Word Finder)Count up the letters there, and you find that the rational choice to avoid a penalty is to guess “a”. This will give you no penalty on 27 words in the list (16 have it as first letter, 12 as the second), and this choice is better than any other (“o” is a close second, with 25 words). So to design the worst word, you should include an “a” in it, so that this first guess produces a hit.It looks as though we’ve got a problem though. Whichever place the “a” turns up in:a_ or _aThe player will be left with 16 words possible in the first case, and 12 words in the second, with absolutely nothing to go on. Damn! These two letter words with a single “a” in them suddenly like good choices! They have a decent chance of winning…But no! There’s a way out. 12 + 16 = 28, but I said that there were 27 two-letter words containing an “a”. Huh? What’s that very first word….?If we choose “aa” we’re saved. The rational player will guess “a” as their very first letter, and then win immediately. So that’s my answer: the very worst choice in hangman is “aa” which against a rational player will produce an immediate loss with one guess and no penalties.****Oh, and in case you were wondering:aa (mass noun, Hawaii): Geology: Basaltic lava forming very rough, jagged masses with a light frothy texture.UPDATE: Jake Williams wondered in comments whether there were any words that would make it impossible for even an irrational player to hang themselves, because they contain so much of the alphabet that any guesses in any order won't lead to hanging. I think that’s another good interpretation of the “worst word”.OK, let’s draw up the hangman thingy. That’s 11 lines. So to avoid completing this, we need to have at least 26 - 10 = 16 unique letters. Is this possible?Yes! There are several words that have 16 unique letters: superacknowledgement, pseudolamellibranchiate, pneumoventriculography, phenylthiocarbamides, formaldehydesulphoxylic, blepharoconjunctivitis. But my favourite is:hippopotomonstrosesquippedaliophobia (noun): the fear of long words.Put this up, and it is literally impossible for your opponent to lose, no matter how badly they play.[*] This suggests one way of losing immediately. Simply choose the a word with a unique number of letters. For example, the longest word in the English language is usually counted as “pneumonoultramicroscopicsilicovolcanoconiosis” with 45 letters. Seeing 45 spaces, the player will know immediately how to win. However, I’m not going to count this as the worst word to choose, because the player will need to make a load of moves to fill it all out.[**] Depending on their aims, a player might frame their approach slightly differently. If they are trying to minimise the probability of being “hanged” but don’t care how many penalties they end up with, they would try to minimise the probability of reaching a certain number of penalties. They would then get out their information theory textbooks and start reading Claude Shannon, who would tell them to choose letters that would maximise their informational gain on each guess. Such a player might make moves that differ somewhat from the “best move to avoid a single penalty” strategy assumed above. Showing how an assumption of such a player would change the result is — left as an exercise.[***] Maybe you should choose A and I before O? Because not many people know that O is a word. But if they’ve chosen a one-letter word, it’s likely to be because they know that and think that you don’t. But if they know that too…. ? You can outsmart yourself round in circles for as long as you like (see Vizzini in The Princess Bride). Flat frequencies are the way to go.[****] With three letters, choosing “baa” will give a similar result. “a” is the most frequent letter in the domain of 1,015 three letter words, so when the player guesses it and you write up “_aa”, the player is left with only one choice: choosing “b” to win. Again, the rational player will win without any penalties, though they now need two turns to get there.
