Why do the Indian police beat people for small mistakes?

Let me narrate an incident. A lady magistrate was very strict on police. She won’t generally grant police custody of persons arrested, or at the most she would grant police custody for a maximum of about 3-4 days even if such custody for a longer period may be justified due to requirements of investigation. It is noteworthy that a maximum of 15 days’ police custody can be granted under law. Secondly, any complaint by an accused person of ill-treatment by police would be taken seriously by her.Then, suddenly this incident happened. She was returning home on rickshaw (this was about 30 years back when Magistrates were not given an official vehicle). Somebody physically snatched her gold chain and ran away. She could not get a chance to look at the criminal. It all happened in fraction of a second.She got FIR registered with police. Seven days passed. Nothing happened. No arrests made. No progress made in investigation. She called the SHO of the police station and threatened him to show progress. The SHO was smart enough. He arrested a person who was a habitual offender for chain-snatching cases. The accused was produced before the Magistrate. [Don’t ask me how the accused could be produced before the same Magistrate who was also the complainant! It was a small town with only one Magistrate. Conflict of interest was something, about which nobody was bothered or even aware.]The lady Magistrate granted 7 days’ police custody straightaway. It happened for the first time that 7 days’ police custody was granted by her, and that too, in one order itself. Police custody got completed. But, nothing happened. Magistrate’s gold chain could not be recovered. Accused was produced again before the Magistrate, with a request for judicial custody this time. Surprise! The Magistrate granted 8 days’ police custody instead!! So, total police custody ordered became the maximum 15 days!!!In addition, the lady Magistrate called the SHO to her chamber. Asked him why the chain could not be recovered after questioning for 7 days also. The SHO politely replied that he tried a lot but the accused person was not admitting the crime.“Tried a lot? What do you mean? Did you try third degree? Did you beat him? I see no signs of any beating? Do you think that the accused would admit to his crime when you ask him with folded hands?” Asked the lady Magistrate.The SHO was waiting for this, perhaps. He promised he would do his “best”.Next day, the SHO returned to the court, unofficially, and met the Magistrate in her chamber. He showed her the gold chain that had been recovered from the accused. She “identified” the gold chain. In due course of time, that gold chain was returned to her by following the legal procedures. Nobody knows whether that gold chain was the actual chain that was snatched, and whether that accused person was the real culprit.After this incident, that lady Magistrate would not hesitate to grant police custody and she would turn blind eye to complaints of ill-treatment by police.I hope you get the message. We are hypocrites. When we have filed FIR and/or are on the side of the victim, we want the police to use third-degree and recover the property stolen or detect the crime properly. If the police does not do it then we feel that the police has taken bribes from the accused person for going soft on the accused. And, if we are on the other side, i.e., from the accused side or from general public, we criticize police for using third degree.How many people would appreciate police if they kill a hardened criminal, a goonda, in an encounter? Because our criminal justice system cannot punish such goondas (many of whom also occupy high political positions in various Governments), we feel happy when some criminal gets “justice” at the hands of police. Remember, killing a person (even if he is a goonda) is the highest degree of third-degree, if I may say so! But, many of us do not mind it if it is done against a real goonda. Isn’t it hypocrisy of the last order?So, where do we put a full-stop?On a serious note, please remember that police in India has a colonial legacy. Police openly beating people with lathis was a commonplace in British India. It has gone into the genetic structure or the DNA of police in India. It is hard-wired now. Police officers cannot simply change. It is considered a part of their duty to use force. They are officially trained how to use lathis. Alas! If only they knew where to use those lathis!! Their lathis may become silent when facing violent mobs, whether in J&K when facing stone-throwers or in Panchkula when facing fallouts of Ram Rahim’s arrest. But, they become active against innocents, such as on people sleeping in Ramlila Maidan in Delhi past midnight at 2 am or on a poor rickshaw-puller.Also note that police is the visible symbol of the state authority. Police uniform further compounds the problem due to the false notion of “vardi ki izzat” (uniform needs to be respected). A police officer does not want to see any insult to uniform and resorts to violent behaviour on small challenges.Arrogance is a natural phenomenon that comes free with police uniform. What is shown in Hindi movies (and, I think also in movies in other Indian languages) about police officers using their fists and lathis (and sometimes, even their firearms) freely, and with impunity, complicates police behaviour. Singham in reel life, inspires Singham in real life, though the discretion is lost as to where to become Singham.But, I would say illiteracy, poverty, lack of knowledge of rights of people, and submissive and tolerant public behaviour, are some causes that are delaying any improvements in the police behaviour. Very few people complain against police excesses. And, there is a tendency amongst senior police officers to ignore such behaviour, wherever possible (may be, because it has been so rampant that a large number of officers may have to be acted against).At the same time, a police officer would think twice before beating an educated person or a rich person (exception is when they are in police lockups).In the case of Prakash Singh v. Union of India, (2006) 8 SCC 1, as a part of various measures for police reform, the Supreme Court had, inter alia, directed that:[1]“There shall be a Police Complaints Authority at the district level to look into complaints against police officers of and up to the rank of Deputy Superintendent of Police. Similarly, there should be another Police Complaints Authority at the State level to look into complaints against officers of the rank of Superintendent of Police and above. The district-level Authority may be headed by a retired District Judge while the State-level Authority may be headed by a retired Judge of the High Court/Supreme Court. The head of the State-level Complaints Authority shall be chosen by the State Government out of a panel of names proposed by the Chief Justice; the head of the district-level Complaints Authority may also be chosen out of a panel of names proposed by the Chief Justice or a Judge of the High Court nominated by him. These Authorities may be assisted by three to five members depending upon the volume of complaints in different States/districts, and they shall be selected by the State Government from a panel prepared by the State Human Rights Commission/Lok Ayukta/State Public Service Commission. The panel may include members from amongst retired civil servants, police officers or officers from any other department, or from the civil society. They would work whole time for the Authority and would have to be suitably remunerated for the services rendered by them. The Authority may also need the services of regular staff to conduct field inquiries. For this purpose, they may utilise the services of retired investigators from the CID, Intelligence, Vigilance or any other organisation. The State-level Complaints Authority would take cognizance of only allegations of serious misconduct by the police personnel, which would include incidents involving death, grievous hurt or rape in police custody. The district-level Complaints Authority would, apart from the above cases, may also inquire into allegations of extortion, land/house grabbing or any incident involving serious abuse of authority. The recommendations of the Complaints Authority, both at the district and State-levels, for any action, departmental or criminal, against a delinquent police officer shall be binding on the authority concerned.”A strict implementation of such directions could have gone a long way to put an end to police misbehaviour, since enquiry would be conducted by an independent authority. However, there is hardly any proper implementation of the directions of the Supreme Court, and if at all there is any implementation in a state, then that is mostly on paper.Yet, I am optimistic of positive changes taking place in future. The answer: technology and awareness about rights. Now, most pockets in India carry a mobile phone with video camera. Any police misbehaviour and the video goes viral, if the victim (or his friend or any other person nearby) has courage to record such video. CCTV cameras are being installed in police stations. People are getting educated about rights. It is a slow process but I am sure in future, we’ll see positive changes in police behaviour. Moreover, there is a realisation among many police officers that a positive police image has many advantages for the police functioning, and that they must discard their negative image. An appeal against the decision of the State Commission shall be filed before the Lokayukta.Criticism :Against federal Spirit : Citizens’ charter bill provides for GRO and Grievances Commission at state and central level, but Parliament doesn’t not have jurisdiction to enact such law. Only State legislature has jurisdiction to make laws regarding state public services.More than ten states have already enacted a Citizen Charter Act or Public Services Guarantee Act in their respective states. There is also a provision for special training of school drop-outs to bring them up to par with students of the same age.Mentally and physically challenged children, entitled to free education in special schools, were included in the definition through an amendment in 2012.It also prohibits all unrecognised schools from practice, and makes provisions for no donation or capitation fees and no interview of the child or parent for admissions.Criticism :The act has been criticised for being hastily-drafted, not consulting many groups active in education, not considering the quality of education, infringing on the rights of private and religious minority schools to administer their system, and for excluding children under six years of age.Problems faced :Poor Response : Lack of awareness about the Act, inability to meet the distance criteria and difficulty in obtaining necessary certificates from government authorities could be some of the reasons for this.The Act provides for admission of children without any certification.
