Evaluation of all involved is part of the core of the success of any decent social enterprise, including education. I disagree with the ‘conflict of interest’ argument unless a supervisor is evaluating teacher performance using only one student evaluator data point — then you have another problem.I had parents and students grading me all the time, especially when I taught in K-12. This makes them public records and helps when you have a curriculum or political disagreement with a principal.

The Department of Homeland Security's (DHS) fall agenda proposes major changes to the H-1B visa program and seeks to redefine both ‘specialty occupation' and the 'employee-employer relationship,’ which currently requires a theoretical and practical application of a body of specialized knowledge and together with at least a bachelor's degree or its equivalent.The issue with a revision to ‘specialty occupation,’ specifically the singular degree requirement is that often the coursework of a related degree provides the specialized knowledge needed to perform job duties.Currently, if an employer determines that an applicant with a mathematics degree is most qualified for a computer programmer position, a technical evaluation must then be submitted with solid documentation demonstrating how the applicant’s coursework is directly connected to the job description, adding time and money to an already complex process.The employer-employee relationship is already intensely scrutinized by USCIS and is evaluated by weighing multiple factors such as who directly supervises the H-1B worker and whether supervision is performed on or off-site. These days, even the use of proprietary information and whether the end work product is directly linked to the H-1B employer's (petitioner's) business is closely examined.Additionally, the DHS is seeking to add requirements for wage levels. USCIS has argued that the job duties paying level 1 wages are not complex enough to qualify as specialized but too complex to be considered entry-level because they involve the exercise of judgment and thus require oversight from a wage level 3 supervisor. Quite the predicament.Also in the works is an update of the Adjustment of Status Procedures for “more efficient processing” by eliminating the concurrent filing of visa petitions and Form I-485 for all applicants seeking an immigrant visa in a preference category and changing the dates when applicants can file Form I-485.Another item on the DHS agenda is to establish a period of authorized stay for F-1 and other non-immigrants. Currently, F-1 students are admitted for a “duration of status” and allowed to remain in the country for the duration of their full course of study, including any period designated for practical training. DHS proposes to replace the “duration of status” system with “date certain” admissions as it apparently causes confusion and contributes to student visa overstay.Lastly, the DHS wants to rescind the February 2015 rule extending eligibility for employment authorization to certain H-4 dependent spouses of H-1B visa workers seeking employment based lawful permanent resident status (green card). The effect will be felt by companies as their labor turnover costs are expected to increase.Restricting H-1B visa issuance and increasing the difficulty for students and other high-skill foreign-nationals has a number of negative effects on our economy.Statistically, every H-1B visa creates almost two jobs for Americans on average. In smaller companies, it can create almost 7 jobs per each H-1B. Reducing H-1Bs reduces jobs for Americans at almost double a rate. Making these high skilled visas tougher to obtain for American companies forces jobs and businesses to leave America.Foreign students, who contribute enormously to higher-education institutions and more often than not enter in-demand STEM fields, have already begun to lose interest in attending US Universities.Indian students have decreased admissions by 28% while Chinese students have decreased by 24%. This translates to a loss of approximately $2 Billion in tuition to US universities annually.Other countries, like Canada and India, are already enjoying increased migration of American companies and foreign nationals to bolster their economy, especially in the tech industry.The US has lead the world in technology by importing people with the highest skills to our inviting and innovative environment. Visa regulations are chilling this environment and could cause us to lose our leadership position and adversely impact our economy.

A friend of mine was five years into his PhD and had made it that far because of his thesis advisor, a man who knew people in the right places. So influential was his thesis advisor that he even managed to get the coveted Senior Research Fellowship (SRF) in his second year, without even publishing a single paper.Not. One. Paper!Every year, when the review committee would turn up to evaluate his performance, his supervisor would weave his magic and get him cleared.It didn’t matter that the head of his own department laughed and ridiculed his work and its progress in front of the review committee, he got his SRF extended anyway.Four years through and still no paper.During his fourth year he presented his work at an inter-disciplinary conference, jointly organised by different departments of our university. Among the audience was the head of the chemistry department, a professor who had done his PhD in drug delivery systems at Caltech.My friend was asked a few simple questions such as “where in the body does the drug dissociate?” or “were the SEM images collected in the solid form or as a colloid?” or “how does the drug get flushed out from the body?” or “what are you going to make the formulation out of?” And he could not answer any of them.“Give up, man!” said the visibly amused professor. “You’re in your final year and you can’t answer the basics of your own work. You seem to be very weak scientifically as well.”I was sitting right in front of the professor while all this was going on and was hanging on to every word the professor spoke.“I am very weak in science,” replied my friend, quite shamelessly. Maybe he didn’t get the professor’s jibe. I face-palmed myself hard. Dude!“You don’t deserve a PhD,” said the professor, who laughed, stood up, mumbled “..I am weak in science..”, chuckled under his breath, and walked towards the door. With one hand on the door knob, he turned to my friend and said, “had you been my student, you wouldn’t have lasted even one year.” And then he walked out.My friend’s project was shit. He didn’t physically design or develop any drugs. His work was all hypothetical, whimsical, and extremely presumptuous, built on whole lot of assumptions and no scientific base. It’s true, he knew no science and had no papers. Yet, here he was, a final year SRF!Eventually, his thesis advisor made him draft a shitty four page manuscript and got it published in a journal overnight. They paid about ₹15,000 for the publication, and even though our university required two first authored papers, he managed to submit his thesis with just the one. Playing tennis and being drinking buddies with the vice-chancellor of the university does help.His final defense was an absolute joke as well. A few master’s students from his department were given preset questions as a part of his post presentation Q&A, the answers to which my friend had memorised. And that was it! He was a PhD!Still want some dark facts about research and publishing? Well..Remember the moral of that story about a rabbit who’s PhD was “Rabbits are more intelligent than Foxes”? It goes like this: In a PhD, all that matters is your advisor. Yeah, if you don’t know the story, look it up (“Fox, Rabbit, Lion and PhD”)You can pay a lot of money to shitty journals and publish your work overnightThere are a lot of people who don’t deserve certain scholarships and yet they get it, leaving many deserving students with no fundingA lot of work is published that doesn’t add anything significant to existing knowledgeAbout 99% of existing research is just an extension of existing knowledge (this isn’t necessarily a bad thing) and barely 1% contributes to anything groundbreaking or new (I’m looking for citations on this!)Really good publications for a particular individual or group comes in batches of 2 or 3 papers, as a result of data accumulated over 1 - 2 years of intense researchSometimes, this individual/group takes the same time to publish 1 really productive, high impact paper, that eventually has the potential to end up with hundreds of citationsStrong collaborations result in stronger papersAny one of the authors knowing the editor of a journal may/may not help the paper getting throughMy friend might have finished his PhD with the help of his thesis advisor, but he’s still rotting at home, desperately searching for a job. Even with his powerful advisor’s help, he still lacks the basic skills needed to be employable.Understand this, there are no substitutes for passion to your work, your willingness to work hard, an unhingeable commitment, and a rock steady focus.
