Seizure Memo: Fill & Download for Free

All kinds of arms, amn, caches etc, recovered during a raid are generally handed over to the local police on vouchers.The procedure followed is as follows :-1. Seizure memo is prepared.2. Recovered items deposited to police.3. Case is registered.4. Then the items are taken to court on hearings.These wpns if recovered frm killed militants goes to forensic lab for test, irrespective of whether the weapon was fired or not.However, ammunition like grenades are generally destroyed in presence of police, being too risky to carry & store. Other arms & ammunition as I said are handed over to police & shown, as part of recovery in FIR.

From 1991 till now , infantry & RR units and their formations, CAPF battalions etc have been recovering all types of assorted arms and ammunition from the terrorists. The recovery includes AK-47/56 rifles, pistols, UMG, HMG, spotter rifles, MMG and rocket launchers, RPG 7V, hand grenades , mines and all types of assorted and belted ammunition. Why I am mentioning the type of arms and ammunition because, for any successful anti terrorist operation, there should be hard intelligence and our intelligence det is responsible for gaining actionable information from sources/informers and we often use them as spotters/guides to lead the SF for operations at hideouts in the remotest jungle , or mountainous dhoks which results in an encounter, resulting in killings and capture of arms and ammunition. Even though, our det provides specific int inputs , based on which the infantry/RR troops carry out operations, captured arms and ammunition from the terrorists are retained with respective units to increase their arms tally and after endorsing them in the Seizure memo followed by a Situation Report, the credit of conducting successful operations and capture of arms/ammunition is given to the intelligence detachment which provided specific int input.These captured arms and ammunition , grenades and mines etc are later deposited with nearby Field Ordnance Depot by units which capture them under a deposit voucher. After inspection and necessary repairs, these captured weapons especially AK-47/56 rifles are kept under custody of the Corps G Branch for maintaining them as Sector Stores and for issuing them to infantry/RR battalions or TA battalions which are newly inducted in the valley.Infantry officers are authorised Sten Machine Carbine or 9mm Pistols as personal weapons for use during combat , but I personally felt that was not enough. I have always carried a new AK-56 Chinese version rifle as personal weapon during operations and the same was a captured rifle. This rifle alongwith 3x magazines of live ammunition was recovered from a Gujjar guide when he lead me to a hide out not far off from our camp , which I have not declared. So, when ever, I used to go out for operations, I used to carry this AK-56 rifle. Quite often than not, during range firing course, I carry out Zeroing of this rifle to ensure 100% accuracy. After all, I should have full faith and confidence in my personal weapon , which always protects me in the time of need. Later, when I was posted out from the valley, I had handed over my beloved AK-56 rifle with ammunition as a gift to the officer who relieved me.

Police prepares a search and seizure memo at the time of arrest. If they have included it in the seizure memo, you can get them back by moving a simple application before the concerned magistrate(court).If police did not make a list that includes your mobile, you are only at their mercy and you need to call your Investigating Officer and bargain with him. Your lawyer asking money as his fees is OK as there is no rate list of the work of a lawyer. If you can not afford him or doubt his credentials, you can hire another. Remember, every lawyer is a professional and he has the right to charge his fees. Since you get indulged in a crime, help of a good criminal lawyer is essential.
