I didn’t think of it as a big deal but it gives an idea about the standard of living being little less compared to the US where even the cheapest apartments would have all these basic things.Finding an apartment is difficult. Leasing offices are not welcoming like US. You have to book appointments during your regular working hours and weekend viewing of apartments is almost none. Also the attitude of the leasing agents is not that great. Last month, they add my rent check towards someone else’s account and then sent me an evacuation notice for unpaid rent. When I went to clear it up they questioned me 10 things to verify if I was telling the truth even when the check has my complete name and address printed on it.Most of my answer revolved around rental apartment and leasing but I moved here 4 months back and that’s the only area I faced an issue with.Everything else about Canada is similar to the US and Canadians at work or places you meet outside are great people. What can I do if my tenant is refusing to pay rent and threatening to sue me if I try and kick him out?

Now that a threat of litigation has been made, you need to terminate the landlord-tenant relationship through eviction. Post a 3-Day Pay or Quit notice on the door. You can make one of these and print it yourself. Tape a copy to each exterior entry.The wording will be pretty consistent in every state, but your state may require other unique information. Look up your state's landlord-tenant laws.The day you post that notice, start the eviction process. Fill out the necessary forms at your local court. Pay the fee and pay to have the process server place the document in the hands of the tenant. Also, send a copy of that to the tenant via regular mail. If you use email with your tenant, after they have been served, email them a copy of the complaint. You want the message to be loud and clear.Be careful accepting any money if you intend to evict. In some states if you accept even a little bit of money, the process must start anew.Follow the steps outlined in your state law to the letter. Do nothing extra and do not overlook any dates by which you must do something.Sometimes, if a landlord wants a tenant gone badly enough, they will offer a cash incentive for the tenant to move. If there are damages, you MUST send a letter to the last known address within a certain number of days after the place is vacated. Some states it is 10 days, in others it is 21, and in a lot it is 30. In some, failing to send the letter via certified, return receipt requested, before the deadline means you forfeit the security deposit and cannot claim damages. In other states you can get awarded for damages and then the remaining amount you owe the tenant can be multiplied by 2 or 3 as a penalty.Damages, including cleaning fees need to be itemized. Broken doors need to be separate from a hole in the living room wall. The hole in the living room needs to be separate from the one in the bedroom. Unpaid rent needs to be included. Do NOT include normal wear and tear. If you say you have to replace the carpet because of stains, be ready to prove the condition of the carpet when the tenant took possession and have the original receipt from when the carpet was installed. If the tenant has been there for nine years, the judge will not give you any money for it. The same is true with painting walls. If the paint is more than a few years old, you will not get it from the judge. If someone tried to break in and a window was broken, the tenant may not be liable unless your lease specifically makes that a tenant responsibility.Also, before you send the damage letter, ascertain if there are any utilities unpaid. Get copies of final bills to include with your evidence. If you pay those, have the paid receipt.Before renting to anyone, search their name online. Look at Facebook to see how they talk about their prior landlord. You do NOT have to provide a reason for not renting to someone. However, if you state a reason, make sure it is one for which you can refuse to rent. It is better to just say, “I cannot approve your application.” Give no reason.Take pictures of everything when someone moves out and again after you prepare the place for a new tenant. Make sure date and time stamps are either on the picture, or make sure the picture file has the correct date/time stamp. If you cannot do that, include that day's newspaper in every picture. If you use video, take your time and allow time for details to be seen. Zoom in and out as needed and try not to have to hit pause while videoing. You do not need to narrate. Do move out videos the same way.
