My tenants have not paid rent since March. Eviction moratorium here in Mass. until Oct 18th. They have changed the locks on their apt without notifying me, and are refusing entrance to show their apt. to potential buyers. What can I do?
The first thing to do is change the locks. Off the top of my head I don’t know what the process is. My guess would be a proper notice of entry period under the terms of the lease (or state law if your lease is lacking that). When you go, have a copy of the lease and your deed (in case they call the cops) and bring a locksmith. You may want to also provide a letter from an attorney telling them that they can’t change the locks. [It may be worthwhile to let the local precinct- and the locksmith- know what is going on.]Regarding the missed rent- make sure you and your tenants are following the requirements under the Eviction Moratorium. It’s important to remind your tenant that the rent is still due. Unless they have provided the correct notice and documentation, you are allowed to charge late fees. You may also want to see if you or your tenant personally qualify for any assistance being provided by the state (or city)- see if you can’t get them to start paying again. Or if you can’t get your mortgage put into forbearance- you’ll still have interest and will have to make the payments eventually but for right now you’ll only have taxes and such for the property. If a spouse cosigns a mortgage for a friend, this means he also had to complete a loan application. On each and every mortgage loan application (aka 1004), there is a box that must be checked as to whether or not a person is married. If the applying spouse checked ‘unmarried’ or ‘single,’ then I would assume you would not be responsible for the debt because you can prove the answer was a lie and the applying spouse was trying to do this behind his/her spouse’s back. If the spouse answered that he/she was married, then the lender (and the title insurer, too), would require that the non-borrowing spouse sign off on the deal with some documentation and a deed that assigns to the co-borrowing spouse their interest in the friend’s property as their ‘sole and separate property.’ The loan documentation (most particularly the Deed of Trust), should also name the co-borrower as a married person as their sole and separate property. It is this type of wording that protects a spouse from being financially responsible for everything their spouse chooses to do.I am not a lawyer so do not take anything I say as legal advice.
