Snopes covered it extensively.[1] Judy Mikovits is a nutjob, but clearly it needs breaking down again.She claims that she published a blockbuster article in the journal Science, which meant that Big Pharma attacked her and destroyed her good name. The article exists. It was an October 2009 article by Vincent Lombardi and a number of other contributors including Mikovits that tied Chronic Fatigue Syndrome to a retrovirus called XMRV. Rather than be immediately attacked as Mikovits’ suggested, the article was gleefully accepted by other scientists working on CFS, who saw is as very useful in developing treatments. Unfortunately, every other scientist who tried to use the paper was unable to replicate the results of this study.Mounting evidence suggested that either she had misrepresented [2] her results, or perhaps through lab contamination, the data was simply an error. In December 2011, the editors of Science retracted the paper in full, saying that they had “lost confidence in the Report and the validity of its conclusion”. The journal went on to say that the research “attracted considerable attention, and its publication in Science has had a far-reaching impact on the community of CFS patients and beyond.” That does not sound like something that had been ignored by the scientific community.That would ordinarily be the end of it, but before Science retracted her paper, Mikovits carried on. Despite the absence of published data, she tied XMRV to autism and a host of other disorders. [3] At the time she was working at Whittemore Peterson Institute in Reno (WPI). Unfortunately for her, the WPI could not reliably find evidence of XMRV in the blood of patients, and concluded that lab contamination was the most likely cause of her unrepeatable results.A 2012 publication from the American Society of Microbiology[4] says “ “Contrary to previous findings, new research finds no link between chronic fatigue syndrome and the viruses XMRV (xenotropic murine leukemia virus-related virus) and pMLV (polytropic murine leukemia virus).”According to a Discover magazine article in July of 2013[5] “the NIH’s AIDS czar, Anthony Fauci, asked his friend Ian Lipkin, a neurologist and virus hunter at the Center for Infection and Immunity at Columbia University’s Mailman School of Public Health, to settle the impasse”. Lipkin’s findings demonstrated that “XMRV was not actually a human pathogen … but a man-made contaminant unwittingly manufactured in a lab in the 1990s.” And who participated in Lipkin’s study and concluded at the time that this was “the definitive answer”, nothing that “There is no evidence that XMRV is a human pathogen?” Why that was Judy Mikovits.[6]None of this was what got her fired from WPI. That was due to her refusal to share cell lines with Vincent Lombardi, the first author on the 2009 paper the proposed the XMRV-chronic fatigue link. When she was fired for insubordination, she asked her “assistant” Max Pfost, to take notebooks and samples from WPI and provide them to her, which he did. [7]Mikovits planned to use the material she had stolen from the lab to try to move grants that were given to WPI to wherever she ended up. There have been sworn affidavits that she arranged for the data to be stolen, that she was in contact with senior figures in the department of health and human services including Ian Lipkin, in an attempt to get the WPI research grants moved to her.According to reporting at the time, WPI filed a civil lawsuit against Mikovits to compel the return of their “misappropriated property” and the lab notebooks and other materials were reported stolen to the local police. She went on the run to avoid being served in the WPI lawsuit and according to Pfost was “hiding out on a boat” in California.Eventually she was found. In her 2014 book “Plague” she described three Ventura County Sheriff's deputies arriving at her door “brandishing a yellow piece of paper” informing her that she had a search warrant (which is online and viewable at the footnote [8] That warrant references a separate arrest warrant for the theft. By the Plandemic documentary that has morphed into her claiming that her home was searched without a warrant, she was arrested without a warrant and “held in jail with no charges”. The WPI materials found in her home has become items that were “not in my possession but planted in my house” as part of the conspiracy to demonise her.She did spend four days in jail in California prior to the arraignment hearing (which became “several years” in the Plandemic video), and subsequently she surrendered to the police in Reno.[9] The criminal charges against Mikovits were eventually dropped[10] , but WPI got an injunction compelling her to return the notebooks that she had arranged to be taken. She refused to comply. Eventually she returned some of the documents and a taken laptop. WPI produced a computer expert who noted that all of the files had recently been deleted from the laptop.After a highly contested court case, Judge Brent Adams of the 2nd Judicial District Court in Washoe county ruled in favour of WPI, upholding all of their claims. In court documents, Mikovits pled the Fifth Amendment, the right not to testify against [11] yourself. After losing, Mikovits filed for bankruptcy.The thing here is not merely that the claims that Mikovits made in the plandemic documentary are contradicted by the claims that Mikovits herself made at the time of these events, but that it would be so easy to prove Mikovits right. She has published clear instructions as to how to replicate her research and nobody, including her, can do it. That’s probably because she was part of the paper that said that her previous research was wrong.Some of the claims that she made such as “she was held in jail with no charges” are just easily provable as false. I am not going to spend much time on the claim that vaccines will kill millions, and that vaccination is incredibly dangerous.There have been plenty of others commenting on anti-vaxx sentiment. It is true, for example that the oral polio vaccine “could itself cause polio”. That was reported by the CDC and was seen in 8–10 children per year across the US.[12] At the time, however, according to NPR [13] “nearly 60,000 children were infected with the virus; thousands were paralyzed, and more than 3,000 died” in 1952 alone. The vaccine allowed the U.S. to eradicate polio.I will however comment on Mikovits report that having a flu vaccine increases a person’s chance of contracting Covid-19. She is asked for her source and cites a research article by Greg C. Wolff, which flashes on the screen[14] . When I started looking at this I presumed that this was a nutjob article, but to the contrary, this is a highly reputable article, which looks at other respiratory diseases (not COVID-19) and concludes“Receipt of influenza vaccination was not associated with virus interference among our population. Examining virus interference by specific respiratory viruses showed mixed results. Vaccine derived virus interference was significantly associated with coronavirus and human metapneumovirus; however, significant protection with vaccination was associated not only with most influenza viruses, but also parainfluenza, RSV, and non-influenza virus coinfections.”This is pretty much the opposite of what Mikovits says that the article said. The Plandemic makers figured that nobody would go read the article to see that Mikovits was wrong. That was a decent assumption.The documentary also includes a news clip purporting that an AIDS activist named Larry Kramer was angry at the Federal government’s handling of the AIDS crisis and wrote an open letter to Fauci, which was fiercely critical. This is true, but leaves a lot out. A March 2020 New York Times article interviewed Kramer [15] He told the Times: “The government has been awful in both cases. They were terrible with AIDS and they’re terrible with this thing.”The Times reports that Kramer was very critical of Fauci in the 1980s. He blamed Fauci for the government’s “slow response to AIDS” and called Fauci a murderer and “incompetent idiot”. The New Yorker quotes Kramer as saying of Fauci, “As far as I was concerned, he was the central focus of evil in the world.” He even compared Fauci at the time to Hitler’s henchman Adolf Eichmann. His open letter to Fauci read, “Anthony Fauci, you are a murderer. Your refusal to hear the screams of AIDS activists early in the crisis resulted in the deaths of thousands of Queers.”Wow, sounds like the Plandemic video got this one right. There is only one thing. The Times reported further that Kramer and Fauci “developed a grudging friendship, and Dr. Fauci helped get Mr. Kramer into a lifesaving experimental drug trial after Mr. Kramer had a liver transplant.”Kramer told the Times of Fauci: “We are friends again. I’m feeling sorry for how he’s being treated. I emailed him this, but his one line answer was, ‘Hunker down.’” In addition, the New Yorker notes that Fauci “did not control the drug-approval process” for HIV/AIDS but does note “he was seen as a barrier to opening access to clinical trials.” The New Yorker article [16] said that he reversed course over time, saying that he “transformed from a conventional bench scientist into a public-health activist who happened to work for the federal government.”Fauci’s detailed article on the governments response to AIDS is also available.[17]The documentary also claim that government scientists including Fauci financially benefit from their government work. The video claims that government scientists are holding patents, providing them with a financial motive for lockdowns and vaccines. Mikovits urges the repeal of a law called the “Bayh-Dole Act.” She says “the act gave government workers the right to patent their discoveries. It destroyed science” and led to conflicts of interest.That act is specifically designed for a pandemic. This 1980 act says that if a company develops a product using federal funds, and cannot produce enough quantities to reasonably satisfy the “health and safety needs” of the U.S., then the government can exercise “march-in” rights and force the patent holder to grant a license under the patent to others to increase the speed of production.I do not see how this destroys science. Frankly, I think that Congress in 1980 was pretty far-sighted.As to the claim that government scientists can receive payments for the use of their discoveries by pharmaceutical companies, this is based on a 2005 article [18] by Janice Hopkins Tanne, who noted that “Anthony Fauci, head of the National Institute of Allergy and Infectious Diseases and his deputy, Clifford Lane, received payments relating to their development of interleukin 2 as a treatment for HIV/AIDS.” But the article goes on to say “Dr Anthony Fauci told the BMJ that as a government employee he was required by law to put his name on the patent for the development of interleukin 2 and was also required by law to receive part of the payment the government received for use of the patent. He said that he felt it was inappropriate to receive payment and donated the entire amount to charity.”The documentary also notes that there is a patent for COVID-19 and a vaccine for it. FactCheck.org carefully analysed these claims back in January.[19] It turns out that they are untrue.Finally there is the claim that the US funded a lab in Wuhan in China. This is in fact true. Concerned with some lab accidents at the US Centers for Disease Control, and questions about biosafety in US government labs, the US did in fact elect to place a federal ban on gain-of-function research[20] . As part of that, they elected to outsource some dangerous research abroad, including to the Wuhan lab.[21]Overall, the documentary presents a few facts, often absent context, and mixed in with a large dose of pure fiction to present a massive conspiracy narrative. I am not a research scientist, but I have hired people, and I am loathe to hire anyone who has a documented record of stealing from her previous employer, and then refusing to give back what she took. So unable to work in science, she has found a second calling as a superficially-credible “expert” for the pseudoscience community.
