Wouldn’t have had a stroke if they had followed basic medical procedures in the case.Birth injuries due to failure to properly monitor, leading to life long problems for the baby.Death of fetus because the doctor failed to identify the location of the uterus properly. Inserted something into the uterus during a procedure on a different part of the body. Caused miscarriage.Don’t even get me started on the nursing home abuse cases.

I’m from a legal background but ended up working in health and social care first a manager and then in compliance. Yes you would have to prove they are responsible if you go down that route I'm sorry for your lost.I understand putting bed rails up is open to abuse confining a person to the bed.Medical staff need to use common sense here .If a person has the potential to have a serious accident especially taking medication that sedate patients or whatever health condition the person has .The medical staff need to assess what the needs are and if bed rails would be safer or not?This boils down to quality of basic care .They are rushed off their feet .Things get over looked forgetting to make sure the alarm is switch on and close to patients bed so they can press if need help.Assessment should be made and written up keep rails up at all times as risk to falling out of bed .Again I'm sorry because if this is the case it could have been avoided.I think in hospitals you need more care assistances just for basic needs drinking ,eating there's never enough even if you had someone sitting with patients all the time would be reassuring but they are left alone sometimes and yes I have seen bed rails down that should be up had to call a member of staff and yes if you are Fragile and fall out of bed you could die .
