XDYeah, after a long wait of one month of NEET results, I finally got admission into MBBS in King George Medical University, Lucknow which has always been my dream college since childhood through my state counselling. 🥳 I'm a medico now. 🥼On the ninth cloud🌈. But really just one line ‘ Dreams come true ‘.🤗In my whole 2 years drop, I had learnt so many lessons, gained so much willing & unwilling experiences, seen so many ups & downs, depression, demotivation, anxiety & breakdowns that I had never thought & expected that I could ever get my dream fulfilled.🥺Amidst all the goods & bads, I just worked hard & hard, tried my best though I couldn't sometimes & always prayed to God ‘Please bhagwanji, meri aur mere parivar me sbki sari mehnat, sangharshon aur sacrifices ko safal bna dijiye. Please mera is bar kisi bhi government college me MBBS me admission ho jaye.’ 🕉From childhood, I always had Kgmu as much dream college somewhere in my heart but as my preparation journey started & went, I started losing my dream. It is the turning point where we stopped treating drug abuse as a public health issue and started treating it as a criminal issue.Mistake #1.Now the merits of the Controlled Substances Act are a subject for another answer, this question deals specifically with marijuana.When you look specifically at marijuana the heart of the problem is with the CSA’s “Schedules of Controlled Substances” and their definitions.The Schedules not only classify the substances, but they also lay into law how much of a crime it is to possess or distribute such a substance under what circumstances.They also determine practices with prescriptions, study, and financial issues.Here is the list of schedules with their definitions:So. Look at that, and without looking it up, just read those definitions and in your mind, pick where you think marijuana belongs.Most people think Schedule IV, some say Schedule V, Some more strict people think Schedule III.Marijuana is classified as Schedule 1.Now in order to really understand how batshit crazy that is, It’s best to look at what drugs are schedule II, in other words, “Not as bad as Marijuana, according to the DEA.”Schedule II drugs include:Meth. (Seriously. Not Kidding.)Coke. (Yup.)Fentanyl.Oxycontin.Dilaudid.So According to the CSA, marijuana is worse than meth. Let that gem sink in.Here’s the thing. By the definitions laid out, those drugs I listed BELONG on Schedule II. Those are classified correctly based on the definitions.What’s in Schedule III?Anabolic Steroids (Again, not kidding)Ketamine.Tylenol with Codeine.Testosterone.Schedule IV?Xanax, Soma, Darvocet, Ambien, Tramadol.So According to the law, marijuana has fewer medical uses and a higher potential for abuse than any of the drugs listed above.Obviously, the case could be made that it has more medical use and lower potential for abuse than most, perhaps all of the drugs listed.BUT, let’s just look at Schedule 1 to examine not only the actual description of Schedule 1, but what it means to be a schedule 1 drug and why it’s so problematic that marijuana is scheduled there.Schedule I substances are described as those that have the following findings:The drug or other substance has a high potential for abuse.The drug or other substance has no currently accepted medical use in treatment in the United States.The drug is not safe to use, even under medical supervision.So 1. Does marijuana have a high potential for abuse?I suppose you could argue that it could …but for the most part, marijuana “abuse” is only “abuse” because it’s illegal in most places for recreational purposes. You don’t typically call smoking cigarettes or drinking beer “Abuse” unless you’re talking extremes.2.. The drug has no accepted medical use in treatment in the US.This one is patently false. Although some of the claims that advocates make about the benefits of marijuana like that it cures cancer are dubious at best, it is very clearly acceptable as a treatment for migraines, anxiety, PTSD, seizure disorders, glaucoma, pain management, the list goes on. So clearly this does not meet the Schedule 1 definition3.) The drug is not safe to use, even under medical supervision.Again, patently false. This is another area where advocates tend to exaggerate, but it is clearly safer than tobacco or alcohol, and also most of the drugs even down to the ones on the Schedule IV list.The drug clearly belongs no higher than Schedule IV, probably V, and it’s completely insane that it’s not Schedule III at the HIGHEST.The DEA in 2001 replied to a petition to reschedule Marijuana as follows:[W]hen it comes to a drug that is currently listed in schedule I, if it is undisputed that such drug has no currently accepted medical use in treatment in the United States and a lack of accepted safety for use under medical supervision, and it is further undisputed that the drug has at least some potential for abuse sufficient to warrant control under the CSA, the drug must remain in schedule I. In such circumstances, placement of the drug in schedules II through V would conflict with the CSA since such drug would not meet the criterion of "a currently accepted medical use in treatment in the United States." 21 USC 812(b).
