PDF Editor FAQ

If your felony record has been expunged, why does it still show up in your background check for secret clearance?

Joseph McFaul provided an excellent answer. If your felony conviction is expunged, it restores most of the rights lost from the conviction. You can possess firearms, vote, obtain most professional licenses, etc. You still may not be able to pass a background investigation. This is because the agencies that conduct background investigations are mostly concerned with what you did, not with the paperwork that might have followed it.If you committed some crime of moral turpitude, your integrity is going to be forever suspect. Does a future employer trust you with trade secrets? Can the government be sure you won’t reveal classified information? If property or money is placed in your care, are they reasonably sure you won’t abscond with it?Past performance is the single best indicator of future performance. If you have done one of these things once, there is an increased likelihood you will do them again, even if the criminal justice system has decided to forgive you. Your past crimes are forgiven, but not always forgotten.I have encountered many individuals who thought that a felony conviction was not that big a deal, and that it would never affect them in their future endeavors. Most of them were wrong. None of us know what life has in store for us. It’s much better to just avoid the felony conviction in the first place, rather than try to repair the consequences after the fact.

My recruiter (Marines) wants me to lie about my child abuse history to MEPS. He told me they would not be able to see it due to confidentiality. Should I do that or will it bite me later on?

As a former investigator who conducted background investigations, listen up.DO NOT FUCKING LIE TO THE FEDERAL GOVERNMENT.YOU ARE NOT THE PRESIDENT. YOU ARE NOT SOMEONE WHO THIS WILL NOT AFFECT.Now that I have your attention.Just, don’t.

What is your police force's biggest comic failure?

There were so many, but this one stood out for me:Our executive staff were unified by the notion that they were all smarter and more experienced than us lesser beings that handled calls for service, performed investigations, and generally did the work. This attitude persisted despite the common knowledge that most of them had been working police types for a very brief time before moving on to an administrative assignment and/or being promoted. A patrolman receiving his first four-year hashmark often had more practical experience that all of the executive staff combined. The executive staff, who were known among we rabble as the “Chairborne Rangers,” prided themselves on their “gut feelings” and ability to instantly assess the character of anyone they encountered. They placed far more trust in this imagined ability to read people than in more conventional methods of vetting, such as background investigations. When our few trained polygraph operators had all promoted to the rank of lieutenant or above (as one rose in rank, anything resembling actual police work became increasingly forbidden to them), the Chairborne Rangers decided they wanted to go a different route with the polygraph function. Traditionally, when a new polygrapher was needed, an officer with demonstrated interrogation skills was selected and sent to the polygraph course. This time, they decided to hire a dedicated polygrapher off the street. The candidate they hired had impressive credentials. He bore a Ph.D. in psychology (and insisted on being addressed as “Doctor ______”) and had graduated from one of the better known polygraphy schools. He had conducted thousands of polygraph examinations for the federal government and private clients. He wasn’t very personable. If someone tried to engage him in casual conversation, he would make it clear that he did not mix with his inferiors, and went on his way.As various witnesses, suspects, and applicants for police jobs passed through his office, it became clear that he had one go-to tactic during examinations. He would pick out some issue among the ones included in the question list, and insist the subject had been deceptive on this point. He would threaten them with everything from prosecution for hindering an investigation to being blackballed from the entire police industry forever. Occasionally, someone would come clean, but most of the time, he was unable to get the subject to admit to their dishonesty. One day, someone made note of the name of the institutions named on the diplomas that adorned his office wall, and made a few phone calls. It was revealed that Dr. ________ had no Ph.D., had never even seen the inside of a polygraph school, and had certainly not conducted other polygraph exams. He was a complete fraud who had been on the police department payroll for over two years. He was quietly fired, as making anything more of this would required one of the Chairbornes to admit they had done a less-than-adequate job at verifying the credentials of their new hire. One can only imagine the damage that was done to the numerous investigations and careers of aspiring police officers.A couple of years ago, I did a Google search for Dr. __________’s name. He is again Dr. ________, this time with some “Oriental naturopathy” degree from an institution I suspect is a diploma mill, practicing pseudo-medicine in the Pacific Northwest.
