You know, that thing conservatives say they love soooo much but never read.So you know how conservatives keep insisting “states’ rights, states’ rights, states’ rights, states’ rights”? Well, the Constitution specifically and explicitly names deciding how elections work as one of the states’ rights. A state does not get to tell another state how to run its elections.The Constitution is very clear about this. Go read it! Article I, Section 4.

I live in India.I had a divorce case with me and the issue of amount of maintenance was something on which the husband and wife could not agree.I was representing the husband. He was a businessman based in Qatar and earned about 4 crore rupees per month ($900,000). Wife wanted a monthly maintenance of 60 lakh rupees ($100,000).The husband had clearly told me that he would not pay more than 30 lakh per month ($50,000) and the wife was not ready to agree on anything less than 55 lakh rupees ($90,000) per month.My client told me that he is leaving for Qatar. She agreed to a monthly maintenance of 10 lakh ($17,000) and filed an affidavit to that effect.By the next date of hearing my client had returned to India and met with his wife directly inside the courtroom where the affidavit had already been filed by the wife. The judge passed a decree of divorce with issue of maintenance settled and the wife did not get a chance to renegotiate the amount of maintenance. The wife could not appeal against the decree either since it was passed with her consent.My client was cleverer than me or perhaps those who earn such large amount of money know how to safeguard it from predators.

We have faced a similar issue last year when I lost my father. Apology for saying so but if you have a similar kind of a case then I can guide you by sharing my experience.My dad had a FD and a bank account in SBI without any name of nominee written in the data. Although, it is compulsory to add a nominee, so I doubt how this happened n why didn't the bank official ask dad to do so. Anyways, what happened was our destiny.So, after few days of his death, we went to SBI along with a Death Certificate, just like we went to PNB and discovered that my mother can't claim the amount as her name is not written anywhere. Luckily, we met a nice bank official and he guided us very well. He asked us to get an affidavit from the court claiming that she is his wife and we, her children have no problem if she gets all the amount. In addition to that, he gave us a form to fill and asked to attach my mother's ID proof and father's death certificate.Getting an affidavit is very simple. Just go to the nearest court and get it done. Ask the SBI official to tell you the amount of stamp paper required.My advice to you is to go to your branch and ask them the procedure once. The procedure will be somewhat similar to what I have mentioned here.Since, I did everything after my dad left us, so I know the pain of banging on every door and asking the procedures.May God give you the courage to face every hurdle on your way.
