The office of sheriff in any county of the United States, including territories, is an elected office. People can stand for election or reelection every four years. The Sheriff’s Office has specifically assigned duties—mostly focusing on the service of official documents such as eviction notices, tax notices, and the execution of warrants for arrest of search, within the county where the sheriff has jurisdiction. In addition, sheriffs maintained the county jail and also were usually employed in the transportation of prisoners to and from state and federal facilities, unless state police or federal marshals were available. Sheriffs also did duty as court bailiffs, oversaw security for various official functions such as civic celebrations’ security needs, even public executions, transport and security of accused individuals to and from the jail to the courthouse or sometimes merely court room—Sheriffs’ offices were typically inside the county courthouse or were in a free-standing jail nearby—conducted searches and pursuit of criminals who left city jurisdiction, and generally served any legal functions that were either beyond or external to other police forces.Sheriffs sometimes were/are the only law enforcement in a county, unless there was a township or village or city that had the organization and the money to hire a police force, such as a town marshal or policeman. Constables could be elected as well, but t their jurisdictions and restrictions were more severe. Sheriffs could hire and appoint deputies, and in counties with more than one community other than the county seat, these individuals might have been the only legal official in those locations.Some sheriffs served multiple terms, being reelected over a period of decades; some were often confronted with stiff competition from rival political parties or political factions within a community and were ousted after a term or even multiple terms. Some were reelected for non-consecutive terms when the political climate or other conditions changed. A sheriff, like any other elected official, could be impeached, but he/she could not be fired.A sheriff was answerable to the County Commission, not to municipal authority, and although all the area of a city or town fell within the Sheriff’s Office’s jurisdiction, as it was inside the county, if there was a civic police entity for the municipality, it took priority for investigation and enforcement of the law. Most of the time, but not always, Sheriff’s Offices cooperated with municipal police forces as well as with state and federal officers if they came into the county to conduct an investigation, make arrests, or enforce state or federal laws.Sheriffs on the frontier were notorious and sometimes infamous; many were legendary for their honesty, virtue, and efficiency. Some would leave the Sheriff’s Office to run for other political offices on the local, state, or even federal level. Some were content to remain sheriffs for as long as voters would return them to office. There was no rule about any of this, no consistency, and from time to time, no sheriff at all, when no one wanted to serve in the office.

Alex and I were radio car partners in the early 1990’s for a cycle, or two on the graveyard shift. I liked him as a partner. He was only at my station for a short time. He helped start our second union, along with a couple of other guys that I knew much better, because I had known them much longer. In my state, a Sheriff is an elected position, and when the term ends, the Sheriff is a civilian again.If the Sheriff was already a sworn officer in that county when they were elected Sheriff, they probably would have had to ask (or grant themselves) a leave of absence. There would definitely be some conflict for their union status because a Deputy is a union member from the part of the bargaining agreement that the Sheriff is not a part of, since the Sheriff is management. But that Sheriff also wouldn’t want to throw away their seniority or civil service position, if applicable, for exactly the reason suggested in the original question.The situation is the same for a city’s Police Chief. If a Patrol Officer is appointed Chief of Police (and for many smaller or midsized departments, this is not be so rare), then that Patrol Officer would want to remain commissioned at their civil service rank, even if inactive, while they serve as appointed Chief of Police (management).But if that Sheriff of a county, or Chief of Police of a city, was elected or appointed from outside the department, then when that role ends, so does their job with that department.
