PDF Editor FAQ

Have you ever beaten a lawyer on a legal question (or if you are a lawyer, have you been beaten by a lay person on a legal question)?

Yes, and it was great!Although he had a law degree he was no longer practicing - and although he had been licensed as a securities broker, he was no longer licensed for that…hmmmm. He did sell real estate, and because he was “a friend of the family (hers)” my s/o and I bought a house from him, in Colorado. Compared to Florida, my home state, this was indeed the wild west, with all sorts of side deals, discounts and “favors” flowing around the deal. As part of the deal, he had verbally agreed to a $5K , out of closing, “rebate” to us.Soon after closing, I called him to arrange payment. He became verbally abusive, talked trash about my s/o’s “attitude” and said he was not inclined to pay. I told him I was too upset to talk about it over the phone, and would email him. Over the next week he admitted to the arrangement in a series of 8–10 emails, but came up with a variety of excuses not to pay. I filed in small claims court, documented everything and waited for the case to be heard. Amazingly, he didn’t bother to show up so I won in a no contest decision.Ooops! He had left the country so I could not serve papers to collect the judgement. I knew he had rented a house, so I went and spoke to his renters and got information on two banks that he had accounts with, and found out about two other houses he owned. I placed liens on three properties and both bank accounts, and waited. I also filed a complaint with the Real Estate Commission, and the State AG for fraud. Over the next few months I waited - the funniest part was the AG’s office. His name was, pronounced slightly off, was a homonym for felon, and in conversation one day they slipped and admitted they called him “Mr. Felon” around the office.Of course, eventually he had to pay to get the liens removed. By that time, with interest it was over $6K. I waited until the last possible day to file the satisfaction of lien with the court and since he was jammed up - this was around the beginning of the real estate crash - his attorney filed a complaint that I had not released the lien a week early. The court was not amused. I sent him a copy of the satisfaction with a note that his lawyer was as competent as he was honest - it was a good day!

How can a homeowner remove a mechanic’s lien when it was placed without a judgment for a crazy high amount that has since been satisfied but the contractor is refusing to remove it?

Not an attorney here, but I’ve dealt with Liens in both directions; filing liens on property for unpaid services and having them filed on me. I’ve even been hired by several banks to administer payments on their construction loans. So just a word of advice; NEVER pay (satisfy) a lien without having the Lienor execute a “Satisfaction and Release of Lien” at the same time (and file it with the Court). By not getting a lien release from your contractor, you left yourself open to this problem. Good luck resolving this; I’d call an attorney skilled in construction law, not an “ordinary” lawyer.Your State should have something like this:Prepared by/ Return to:SATISFACTION AND RELEASE OF LIENSTATE OF FLORIDACOUNTY OF _____________Before me, the undersigned notary public, personally appeared ________________, who was duly sworn and says that he is the Agent of Lienor _________________, a corporation, having filed a Claim of Lien against the property of _____________________, on the ____ day of__________, 20__ in the Official Records of ________ County, Book _______ page _______ on the following described real property in _________ County, Florida: in the amount of $_______________.NOW, THEREFORE, the undersigned does hereby acknowledge satisfaction of the Claim of Lien and does direct the Clerk of the Circuit Court to release, cancel and discharge the Claim of Lien in accordance with Section 713.21 of the Florida Statutes.Signed and Sealed and Delivered this ____ day of _____________, 20__.(Lienor)_____________________________Agent for LienorSTATE OF FLORIDACOUNTY OF BREVARDThe foregoing instrument was acknowledged before me this ____ day of ____________, 20____, by ____________________, Agent for _________________, who is personally known to me or has produced ________________________ as identification and who did/did not take an oath.(SEAL)_____________________________Notary PublicF.S. 713.21 Current as of February 4, 2010

How do liberals feel about unemployment rate going down to 4.5% after President Trump introduced policies?

While campaigning, Donald Trump made claims that the official unemployment rate—which was close to what it is today, about 5 percent—vastly undercounted the number of people who were actually unemployed. He said the real number was somewhere around 24 percent and possibly as high as 42 percent. Now that he’s in office, he believes the number is correct AND he takes credit for it.He lies without compunction. He ran on platform of being a champion for American workers, yet his history shows nothing but contempt for them. He screwed workers and small businesses left and right. Hundreds Of Donald Trump’s Employees Have Sued For Alleged Labor Infractions“At least 60 lawsuits, along with hundreds of liens, judgments, and other government filings document people who have accused Trump and his businesses of failing to pay them for their work. Among them: a dishwasher in Florida. A glass company in New Jersey. A carpet company. A plumber. Painters. Forty-eight waiters. Dozens of bartenders and other hourly workers at his resorts and clubs, coast to coast. Real estate brokers who sold his properties. And, ironically, several law firms that once represented him in these suits and others.Trump’s companies have also been cited for 24 violations of the Fair Labor Standards Act since 2005 for failing to pay overtime or minimum wage, according to U.S. Department of Labor data. That includes 21 citations against the defunct Trump Plaza in Atlantic City and three against the also out-of-business Trump Mortgage LLC in New York. Both cases were resolved by the companies agreeing to pay back wages.”Hundreds allege Donald Trump doesn’t pay his billsSince 2010 he pursued 500 visas for foreign workers at Palm Beach’s Mar-a-Lago resort, passing over hundreds of American applicants for the same jobs. The Definitive Roundup of Trump’s Scandals and Business Failures | The National ReviewHe hires non-union workers 80% of the time. When Donald Trump Had a Choice, He Chose Nonunion Labor for His Construction Projects with IBEW | Report from the AFLCIOHe ripped off his workers on a regular basis. In just one case, the Trump Organization paid $475,000 to settle a claim with nearly 300 Los Angeles golf club employees in a class-action suit alleging unpaid wages. Hundreds Of Donald Trump’s Employees Have Sued For Alleged Labor InfractionsHe’s had many problems with labor unions at his hotels. The workers at the Trump Hotel in Las Vegas won an election to organize with the Culinary Union last December, and the National Labor Relations Board affirmed the decision, but Trump refused to recognize the vote of roughly 500 workers. And he plans to run our country like he runs his business?!
