In 2014, I mailed my OPT EAD application to USCIS through regular USPS mail - an unfortunate decision where I tried to save myself $10 being the miserly grad student that I was.OPT applications are supposed to reach the USCIS within 30 days of issuing your new I-20 and mine reached on the 30th day thanks to my poor judgement. I mailed my application around April and was supposed to join my employment in July with my OPT EAD issued by the USCIS.After processing my application for 90 days, USCIS let me know that my application was rejected. Dejected, I had to go through the process of obtaining a new I-20 and shuddered at the thought of waiting another 90 days to get my EAD and join my employment six months later than the date I was supposed to join!Not to forget that international students have mere 90 days of grace period to remain in the US post graduation without a job and this would mean self-deportation for a tiny albeit expensive mistake on my part to use standard mail and not express mail.I reached out to the local congresswoman in my district, Rep. Susan Delbene, who was extremely sympathetic to my cause. Within two days, she made me mail my USCIS rejection letter and all the documents required for the OPT EAD and she made a case on my behalf to the USCIS to expedite my OPT application. I received my OPT EAD within 10 days! Felt like a miracle and I am forever indebted to the congresswoman in my district. What a kind person!So yes, if you were to find a local congressman/woman who is sympathetic to your cause and can make a strong case on your behalf, I believe you can get your application expedited.

What is the US immigration department (USCIS) doing to make it easier for Indian EB2 category candidates to get green cards?

USCIS has no interest in doing anything to make it easier for Indians (or anyone else) to get green cards in the EB2 category (or in any other category). USCIS’s obligation is to assiduously follow the law that Congress has written in this regard. That law says that only 7% of the people admitted as immigrants in any single fiscal year may be born in the same country. Vastly more Indians are seeking to immigrate to the United States than can be admitted in any given fiscal year without violating this rule, and so the vast majority of them have to wait until a later fiscal year to be admitted.USCIS doesn’t make these rules. Congress makes these rules. If and when Congress decides that it is willing to allow more immigrants generally, or more Indians specifically, and amends the immigration laws of the United States to do so, USCIS will process those applications in whatever manner Congress directs.Given that the current Congress likely has more people who want to see immigration reduced rather than increased, I do not think that the odds that anything will be done to make it easier for Indians (or anyone else) to immigrate to the United States are at all good.I will state that very few Americans consider the long waiting list for Indian EB2 green cards to be a significant concern. While you can get a good portion of Americans to agree that it’s wrong that it takes so long, it’s not something most of them care about; they’re far more concerned about health care, education, job creation, national security, abortion, gay marriage, or taxes. The misfortunate plight of some foreigner waiting on a line to get into the country for decades at a time just isn’t important enough to sway voters. Because it’s not important to voters, it’s not important to Congress: Congress cares about things that are important to voters.
