Because the attorney is using the word “answer” in a nontechnical sense to mean “any responsive pleading or motion.” As far as the deadline rules are concerned, there is no difference between an answer and a motion to dismiss. When the judge grants the defendant an extension of time to respond to the plaintiff’s complaint, the extension of time applies to both pleadings and motions.Let’s take a quick look at an excerpt from Rule 12 of the Federal Rules of Civil Procedure (FRCP). Rule 12 establishes a presumptive 21-day deadline for filing an answer to the plaintiff’s complaint. But it also gives the defendant the option of filing a motion to dismiss instead of filing an answer.In other words, a motion to dismiss is a permissible substitute for an answer.The official waiver form that allows defendants to extend the 21-day deadline to 60 days makes it clear that responsive pleadings and motions to dismiss are treated the same for purposes of the deadline rules.
