A confidence motion is the usual constitutional mechanism for the legislature to try to take executive power or indeed to stop the executive. In any other time in history a confidence motion and general election would be called when such a conflict as is apparent arose.A confidence motion however does nothing to help the partisan remainer element in the legislature that has through personal agency seized power. So we have seen unprecedented movements instead.The supreme court ruling that was made up and set a dangerous precedent going forward. If parliament was against prorogation they could have called no confidence. Instead they brought the judiciary into politics that was all too willing to be used as a weapon for partisan advantage.Plus we have the Benn bill which is the legislature trying to take advantage of the unique position of power that parliament enjoys to extend its remit and minutely control the executive in an attempt to seize its power without having to actually let voters into booths to see if they have democratic entitlement to executive power.If the opposition calls no confidence and wins then we have an election. That is the mechanism for stopping the executive not running to the courts and formulating elaborate legislative devices for personal motives. Strictly speaking if no confidence is not called then the executive has the confidence of the legislature.Boris Johnson by challenging them to do this is effectively saying “stop me now or I will presume my government has your confidence”.
