Most of the times feminists were critisied for this law in India that they always take advantage of this biased law. This verdict is such a relief for such people.The government has given one affidavit where it recited the age old ethos of “ tradition and culture of institution of marriage in India”. But the Supreme Court didn't buy this and stated one apt decision as per the requirement of 21st century, by abolishing one 150years old IPC. We must realise that staying in failed marriage is not something related to tradition. Such cases are not even reported or known to our law and system. In urban areas people were involved in adultery secretly. What law would search and punsih them? And court has just removed the crimal charge, it has not declared this is some valid conduct. Adultery is more of an moral conduct than a legal conduct.No I am not at all advocating or supporting adultery, if anyone gets confused. But the thing is due to this law, people used to cheat more often in order to sustain the law. And in that fake life the innocent ones would stay in a false notion that their partner is loyal or their married life is going well. All here know, what I am talking about.More often we have seen some women would put false charge against men for adultery. If the Apex court would keep the criminal charge against both men and women, it would again be misused by both of them. Means now men would charge false case against women for adultery. That's why I welcome the decision of the Apex court to remove section 497 as criminal offence.One more step towards equality.
